Book of Marriage
بَابُ مَا جَاءَ فِيمَنْ طَلَّقَ قَبْلَ أَنْ يَمْلِكَ
Chapter: What is reported regarding one who divorces before having ownership
Hadith Number: 1040
نا خلف بن خليفة , قال: سالت منصور بن زاذان , عن رجل ذكر له امراة، فقال:" إن تزوجتها فهي طالق" . قال: قال: وكان الحسن " لا يراه شيئا" .
It is narrated from Hasan al-Basri (may Allah have mercy on him) that if someone said: "If I marry such-and-such woman, then she is divorced," he said: "This is nothing."

Hadith Number: 1041
نا خلف بن خليفة , قال: سالت ابا هاشم، فقال: " هي طالق فما يريد" .
Hazrat Abu Hashim (may Allah have mercy on him) was asked, so he said: "That divorce has taken place as he intended."

Hadith Number: 1042
نا نا ابو عوانة، عن محمد بن قيس , ان رجلا قال لجارية صغيرة: إن تزوجتها فهي طالق. فشبت فرغب فيها، فتزوجها، ثم إنه وقع في نفسه من ذلك، فقال لي: سل لي عن ذلك. فلقيت عامرا الشعبي , فسالته، فقال: ائت إبراهيم , فإني تركته بمكان كذا وكذا، فاساله، ثم ارجع إلي، فاخبرني بما يقول. قال: فلقيته فسالته، فذكر عن علقمة , او الاسود , قال: قال عبد الله:" هي كما قال"، فرجعت إلى عامر فاخبرته، فقال: صدق، هو كما قال. فلقيت الزوج فاخبرته بالذي قالا، فاتى امراته فاخبرها انها احق بنفسها، ثم خطبها فتزوجها .
It is narrated from Muhammad bin Qais (may Allah have mercy on him) that a man proposed marriage to a young girl and said that if he married her, she would be divorced. When she grew up and the marriage took place, Hazrat Amir Sha'bi (may Allah have mercy on him) told him to ask Ibrahim Nakha'i (may Allah have mercy on him). Ibrahim (may Allah have mercy on him) narrated from Alqama or Aswad (may Allah have mercy on them both) that Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: "What was said has taken effect."

Hadith Number: 1043
نا نا حبان بن علي، نا جويبر، عن الضحاك، قال: قال عبد الله بن مسعود : " إذا قال الرجل: كل امراة اتزوجها فهي طالق , قال: فليس بشيء إلا ان يوقت" .
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: "Whoever says that every woman whom I marry is divorced, then this is nothing until he specifies a time."

Hadith Number: 1044
نا حماد بن زيد، عن منصور، عن إبراهيم , في رجل قال إن تزوجت فلانة، او قال: من بيت فلان، فهي طالق، فإن تزوج فهي طالق، وإن قال: كل امراة يتزوجها فهي طالق، فليس بشيء" .
It is narrated from Ibrahim Nakha'i, may Allah have mercy on him, that if someone says: If I marry a woman from such-and-such or such-and-such family, then she is divorced, then after marriage, divorce will take place. And if he says: Every woman whom I marry is divorced, then this is nothing.

Hadith Number: 1045
نا هشيم، انا مغيرة، عن إبراهيم , انه قال في رجل قال: كل امراة يتزوجها فهي طالق , قال:" ليس بشيء، هذا رجل من المحصنات. وإذا قال: إن تزوجت فلانة فهي طالق، فإن تزوجها فهي طالق كما قال" .
Ibrahim Nakha'i (may Allah have mercy on him) said: "Whoever says that every woman whom I marry is divorced, then this means nothing. But if he mentions a specific woman by name and says this, then after marriage divorce will take place."

Hadith Number: 1046
نا هشيم، انا مغيرة، عن إبراهيم، انه كان يقول: " إذا سماها او نسبها، او سمى مصرا، او وقت وقتا، فهو كما قال" .
Ibrahim (may Allah have mercy on him) said: "If a woman is specified by name, lineage, city, or time, then the matter will be as such."

نا هشيم، انا إسماعيل بن ابي خالد، عن الشعبي، انه كان يقول مثل ذلك.
Hazrat Aamir Sha'bi (may Allah have mercy on him) also used to say the same.

Hadith Number: 1048
نا خالد، عن مغيرة، والشعبي , في رجل قال: كل امراة يتزوجها فهي طالق، قالا:" ليس بشيء حرم المحصنات. فإذا قال: كل امراة يتزوجها من بني فلان، او من مصر، او قبيلة، فهي طالق كما قال" .
Hazrat Mughira and Amir Sha'bi, may Allah have mercy on them, said: "If someone pronounces divorce upon every married woman, it is nothing, but if he specifies a particular tribe or city, then whatever he said will take effect."

Hadith Number: 1049
نا خالد بن عبد الله، عن صالح بن مسلم، ومطرف، عن الشعبي , في رجل قال لامراته:" إن تزوجت امراة ما دمت عندي فهي طالق. قلت: ظني انه كان عقيبه , فهو كما قال" ، فسقط من النسخة.
It is narrated from Hazrat Aamir Sha'bi (may Allah have mercy on him) that if someone said: "As long as you are in my marriage, if I marry another woman, then she will be divorced," he said: "It is just as he said."
