بَابُ مَا جَاءَ فِي نَفَقَةِ الْحَامِلِ
Chapter: What is reported regarding the maintenance of a pregnant woman
Hadith Number: 1393
نا هشيم، قال: انا يونس، عن ابن سيرين، قال: كان يقول:" ينفق عليها من جميع المال". قال: كان ذلك رايه، حتى ولي تركة ابن اخ له , ترك ام ولد له وهي حامل , فكره ان يعمل فيها برايه , فارسل إلى عبد الملك بن يعلى قاضي البصرة، فساله عن ذلك، فقال:" لا نفقة لها" .

Hadith Number: 1394
نا فضيل بن عياض، عن محمد بن سالم، عن الشعبي، قال: " إذا طلق الرجل الامة وهي حامل فليس لها نفقة , لان ولده لقوم آخرين" .
Hazrat Sha'bi (may Allah have mercy on him) says that if a person's pregnant slave woman is divorced, then there is no maintenance for her, because the child will belong to another people.

Hadith Number: 1395
نا هشيم، قال: انا الشيباني، عن الشعبي، انه كان يقول: " إذا كانت الامة تحت الحر او العبد، وطلقها تطليقتين وهي حامل، فعلى زوجها النفقة والسكنى حتى تضع حملها" .
Hazrat Sha'bi (may Allah have mercy on him) says that if a slave woman is married to a free man or a slave, and she is divorced twice while she is pregnant, then it is obligatory upon the husband to provide maintenance and residence for her until the child is born.

Hadith Number: 1396
نا هشيم، قال: انا يونس، عن الحسن، انه كان يقول: " إذا طلقها تطليقتين وهي حامل فعليه النفقة، حرة كانت او امة، حرا كان زوجها او عبدا" .
Hasan (may Allah have mercy on him) says: If a pregnant woman is given two divorces, then maintenance is obligatory for her, whether she is free or a slave, and whether the husband is free or a slave.

Hadith Number: 1397
نا هشيم، قال: انا يونس، عن الحسن،" انه كان يرى للمراة النفقة على زوجها حتى يدخل بها" .
Hasan (may Allah have mercy on him) said that the maintenance (nafaqah) of a woman is obligatory upon the husband as long as he has not had intercourse with her.

Hadith Number: 1398
نا هشيم، قال: انا حسام بن مصك، عن ابي معشر، عن إبراهيم، انه كان يقول: " لا نفقة لها إلا ان تطلب" .
Ibrahim (may Allah have mercy on him) says that a woman is entitled to maintenance wherever she is, as long as she does not demand maintenance.

Hadith Number: 1399
نا هشيم، قال: انا مطرف، عن الشعبي، انه كان يقول: " ليس لها النفقة على زوجها إذا كان الحبس من قبلها" .
Hazrat Sha'bi (may Allah have mercy on him) says that if the imprisonment is from the woman's side, then for her husband there is neither obligation of maintenance nor lodging.

نا خالد بن عبد الله، وجرير، عن مطرف، عن الشعبي، انه كان يقول مثل ذلك.
A narration similar to this is reported from Hazrat Sha'bi (may Allah have mercy on him).

نا هشيم، قال: انا مغيرة، عن إبراهيم، قال: " يقضى للمراة على زوجها في قوتها نصف صاع بر كل يوم" .
Ibrahim (may Allah have mercy on him) said: The maintenance of a woman should be fixed for her husband as half a sa’ of wheat daily.

نا جرير، عن مغيرة، عن إبراهيم، قال: " فرض للمطلقة نصف صاع كل يوم من قمح" .
Ibrahim (may Allah have mercy on him) said: For a divorced woman, half a sa’ of wheat has been made obligatory for each day.
