Book of Divorce
بَابُ مَا جَاءَ فِي الْإِيلَاءِ
Chapter: What is reported regarding ila' (oath of abstention from wife)
Hadith Number: 1477
حدثنا سفيان، عن عمرو بن دينار، عن عكرمة، قال: " ليس الطلاق بعد الخلع شيئا" .
Hazrat Ikrimah (may Allah have mercy on him) said: After khul‘, divorce has no validity.

Hadith Number: 1478
حدثنا هشيم، عن يونس، ومنصور، عن الحسن، انه كان يقول: " لا يلحقها طلاقه إياها إذا كانت في عدة بائنة" .
Hasan al-Basri (may Allah have mercy on him) said: If the waiting period is irrevocable, the husband's divorce does not apply.

Hadith Number: 1479
حدثنا هشيم، نا حجاج، عن عطاء، انه سمعه يقول مثل ذلك.
Hazrat Ata (may Allah have mercy on him) also said that divorce does not take effect during the waiting period of irrevocable separation.

حدثنا هشيم، نا منصور، عن عمرو بن هرمز، عن جابر بن زيد، انه قال ذلك.
Hazrat Jabir bin Zaid (may Allah have mercy on him) also said the same thing.

Hadith Number: 1481
حدثنا هشيم، انا يونس، عن الحسن، ومغيرة، عن إبراهيم، ومالك بن مغول، عن الشعبي، انهم قالوا: " عدة المختلعة مثل عدة المطلقة" .
Hazrat Hasan, Ibrahim, and Shabi (may Allah have mercy on them) said: The waiting period (‘iddah) of a woman who has taken khula‘ is equal to the waiting period of a divorced woman.

Hadith Number: 1482
حدثنا هشيم، نا مغيرة، عن إبراهيم، والشعبي، في رجل طلق امراته وهي امة تطليقتين فاشتراها , قالوا:" لا تحل له حتى تنكح زوجا غيره، ولا تحل له إلا من الباب الذي حرمت عليه" .
Ibrahim and Sha'bi, may Allah have mercy on them, said: If a person buys his slave-girl after giving her two divorces, then she will become lawful for him through the same means by which she became unlawful.

Hadith Number: 1483
حدثنا ابو معاوية، نا الاعمش، عن مسلم بن صبيح، عن مسروق ," في رجل كانت عنده امة، فطلقها تطليقتين ثم اشتراها، ايقع عليها؟ فكره ذلك مسروق" .
Hazrat Masruq (may Allah have mercy on him) said: Whoever gave his slave-girl two divorces and then bought her again, it is disliked for him to have relations with her.

Hadith Number: 1484
حدثنا حدثنا هشيم، نا خالد الحذاء، عن ابي معشر، عن إبراهيم، عن علي، والحكم عن علي رضي الله عنه , قال: " لا تحل له حتى تنكح زوجا غيره" . وذكر احدهما عن عبيدة , عن علي .
It is narrated from Sayyiduna Ali (may Allah be pleased with him) that: She is not lawful for her former husband until she marries another husband.

Hadith Number: 1485
حدثنا حدثنا يحيى بن سعيد، قال: حدثت ان عثمان بن عفان , وزيد بن ثابت , قالا: " لا تحل له حتى تنكح زوجا غيره" .
Sayyiduna Uthman bin Affan and Zayd bin Thabit (may Allah be pleased with them) said: Until she marries another (man), she is not lawful for the previous husband.

حدثنا حدثنا هشيم، اخبرني عثمان بن حكيم الانصاري، نا سليمان بن يسار، ان رجلا تزوج امة كانت لكثير بن الصلت فطلقها البتة , فضرب الدهر من ضربه واصاب الرجل مالا، فاتى كثير بن الصلت فابتاع منه الجارية فلما اوجبها له , قال: لا تعجل حتى ارجع إليك، فاتى مروان بن الحكم يذكر ذلك له، فقال له مروان: انطلق إلى زيد بن ثابت , فاساله عن ذلك، فانطلق الرجل إلى زيد , قال سليمان بن يسار: فجاء إلى زيد وانا عنده فساله، فقال:" لا تحل له حتى تنكح زوجا غيره"، فانطلق كثير إلى الرجل فاخبره، فقال الرجل: اشهدوا انه قد اعتقها , وتزوجها واصدقها كذا وكذا، فقال كثير: لا تعجل حتى ارجع إليك، فاتى زيد بن ثابت فذكر ذلك له، فقال:" لا تحل له حتى تنكح زوجا غيره" .
A man married a slave woman, then divorced her. After buying her, he wanted to marry her again. Sayyiduna Zayd bin Thabit (may Allah be pleased with him) said: She cannot be lawful for him until she marries another husband.
