Book of Divorce
بَابُ مَا جَاءَ فِي الْإِيلَاءِ
Chapter: What is reported regarding ila' (oath of abstention from wife)
Hadith Number: 1487
حدثنا حدثنا سفيان، عن عمرو بن دينار، عن ابي معبد، ان عبدا لابن عباس , طلق امراته تطليقتين , فقال له:" ارجعها فابى، فوهبها له , وقال: استحلها بملك اليمين" .
The servant of Abdullah bin Abbas (may Allah be pleased with them) gave his wife two divorces. Abdullah bin Abbas (may Allah be pleased with them) said: Take her back. He refused, so Ibn Abbas (may Allah be pleased with him) made the servant her master.

Hadith Number: 1488
حدثنا حدثنا هشيم، نا الزبير، عن ابي معبد، ان غلاما لابن عباس طلق امراته تطليقتين، فقال ابن عباس:" ارجعها لا ام لك فإنه ليس لك من الامر شيء"، فابى، فقال:" هي لك فاتخذها" .
The servant of Abdullah bin Abbas (may Allah be pleased with them both) gave his wife two divorces. Abdullah bin Abbas (may Allah be pleased with them both) said: Take her back, otherwise you have no authority. The servant kept her for himself.

Hadith Number: 1489
حدثنا حدثنا هشيم، انا يونس، عن الحسن، عن زيد بن ثابت ، انه كان يقول: " الرجل يطلق امراته وهي امة تطليقتين فوطئها سيدها , إن زوجها إن شاء ان يخطبها" , قال سعيد: بئس ما قال.
Sayyiduna Zaid bin Thabit (may Allah be pleased with him) said: If a husband gives his slave woman two divorces and then sells her, and the (new) owner has intercourse with her, then if the (former) husband wishes to marry her, he can do so. Sa'id said: He has spoken very badly.

Hadith Number: 1490
اخبرنا اخبرنا خالد الحذاء، عن مروان الاصفر، عن ابي رافع،" ان عثمان بن عفان ، وزيد بن ثابت سئلا عن ذلك، فرخصا فيه , وعلي جالس فقام مغضبا كارها لما قالا" .
Sayyiduna Uthman bin Affan, Zaid bin Thabit, and Ali (may Allah be pleased with them) were asked about this. Uthman and Zaid permitted it, but Sayyiduna Ali (may Allah be pleased with him) became angry, stood up, and expressed strong disapproval of it.

Hadith Number: 1491
حدثنا حماد بن زيد، عن ابي عبد الله الشقري، عن عامر، عن مسروق،" في رجل كانت تحته امة فطلقها تطليقتين، ثم غشيها سيدها، اتحل لزوجها؟ , فقال:" سمعت الله تعالى يقول: حتى تنكح زوجا غيره سورة البقرة آية 230 , وليس هذا بزوج" .
Hazrat Masruq (may Allah have mercy on him) said that whoever gave his slave woman two divorces and then her master had intercourse with her, she would not be lawful for him because Allah Almighty has said «حَتّٰى تَنْكِحَ زَوْجًا غَيْرَهُ» and this is not a marriage.

Hadith Number: 1492
حدثنا هشيم، انا مغيرة، عن إبراهيم، والشعبي،" في الامة إذا طلقت فنكحها سيدها , انها لا تحل له حتى تنكح زوجا غيره".
Ibrahim and Sha'bi, may Allah have mercy on them, said that when a slave-girl is divorced and her master marries her, she will not be lawful for him until she marries another husband.

Hadith Number: 1493
حدثنا هشيم، انا ابن عوف، عن الشعبي، قال: شهدت قيسا الزيات سال مسروقا , فرخص له ان يتزوجها، فلما ادبر دعاه، فقال له:" ابرا إليك مما قلت، والله ما ارى استحلاله فرجها إلا بزوج" وما ادري ما فعل .
Hazrat Sha'bi (may Allah have mercy on him) narrated that Qais al-Zayyat asked Hazrat Masruq (may Allah have mercy on him), first sought permission, then called him and said: "I am free from my previous statement. By Allah, I do not see that it is permissible for her to be lawful without marriage."
