Book of Divorce
بَابُ مَا جَاءَ فِي مَتَاعِ الْمُطَلَّقَةِ
Chapter on what is reported regarding the provision for a divorced woman
Hadith Number: 1773
نا نا هشيم، قال: انا ابن ابي ليلى، عن نافع، عن ابن عمر ، قال: " لكل مطلقة متاع إلا التي طلقها قبل ان يدخل بها، وقد كان فرض لها، فلها نصف الصداق" .
Sayyiduna Ibn Umar (may Allah be pleased with them both) said: "Every divorced woman is entitled to maintenance, except for the one who was divorced before consummation and a dowry was specified for her; in that case, she will receive half of the dowry."

Hadith Number: 1774
نا هشيم، قال: انا يونس، عن الحسن، قال: " لكل مطلقة متاع" .
Sayyiduna Hasan (may Allah have mercy on him) said: "Every divorced woman is entitled to provision (mut‘ah)."

نا هشيم، قال: انا عبد الملك، عن عطاء، انه قال: " لكل مطلقة متاع إلا التي طلقها قبل ان يدخل بها، وقد فرض لها، فلها نصف الصداق" .
Sayyiduna Ata (may Allah have mercy on him) said: "Every divorced woman is entitled to provision, except for the one who was divorced before consummation and a dowry was specified for her, then she will receive half of the dowry."

نا هشيم، قال: انا داود، عن الشعبي، انه قال: " في المتاع درع، وخمار، وملحفة، وجلباب" .
Hazrat Sha'bi (may Allah have mercy on him) said: "In the belongings, one shirt, one scarf, one sheet, and one jilbab should be given."

Hadith Number: 1777
نا هشيم، قال: انا مغيرة، عن إبراهيم، ومحمد بن سالم، عن الشعبي، انهما قالا: " لكل مطلقة متاع إلا التي طلقها، وقد فرض لها قبل ان يدخل بها، فلها نصف الصداق" .
Ibrahim and Sha'bi, may Allah have mercy on them, said: "Every divorced woman is entitled to provision (mut‘ah) except for the one who was divorced before consummation and for whom a dowry had been specified."

Hadith Number: 1778
نا هشيم، قال: انا يونس، عن الحسن، انه سئل عن المتعة، فقال:" كان منهم من متع بالخادم والنفقة، ومن كان دون ذلك متع بالنفقة والكسوة، ومن كان دون ذلك متع بملحفة، ودرع، وجلباب، ومن كان دون ذلك متع بثوب واحد" .
Hasan (may Allah have mercy on him) said: "A wealthy person should give a servant and spend, a person of moderate means should spend and give clothing, a weak person should give a sheet, a shirt, or a jilbab, and a poor person should give a single garment."

Hadith Number: 1779
نا هشيم، قال: انا منصور، ويونس، وهشام، عن ابن سيرين، عن شريح، ان امراة خاصمت زوجها إلى شريح في المتعة، فقال شريح:" لا تاب ان تكون من المحسنين، لا تاب ان تكون من المتقين" ، ولم يجبره.
A woman came to Hazrat Shurayh (may Allah have mercy on him) with a case regarding property, so he said to the husband: "Be among the doers of good and the God-fearing." But he did not compel him.

Hadith Number: 1780
نا هشيم، قال: انا جوبير، عن الضحاك، انه قال: " لكل مطلقة متاع حتى المختلعة" .
Hazrat Dhahhak (may Allah have mercy on him) said: "Every divorced woman is entitled to provision, even the one who has obtained khula."

Hadith Number: 1781
نا نا سفيان، عن عمرو بن دينار، قال: طلق ابن عمر امراة له، فقالت له: " هل رايت مني شيئا تكرهه؟ قال: لا"، قالت: ففيم تطلق العفيفة المسلمة؟ قال: فارتجعها .
Sayyiduna Ibn Umar (may Allah be pleased with them both) divorced his wife. She said: "Did you see anything undesirable in me?" He replied: "No." She said: "Then for what reason is a chaste Muslim woman divorced?" So he took her back.

Hadith Number: 1782
نا نا سفيان، عن عمرو بن دينار، عن عطاء، عن ابن عباس ، قال: " إذا فوض إلى الرجل فطلق قبل ان يمس ويفرض فليس لها إلا المتاع" .
Ibn Abbas (may Allah be pleased with them both) said: "When a man has the authority to contract marriage, then divorces (the woman) without consummation and without specifying a dowry, the woman is entitled only to a gift."
