Imam Malik, may Allah have mercy on him, said that if the sons of a mukatab are minors and cannot work or labor, then their coming of age will not be waited for, and they will become the slaves of their father's master. However, if the mukatab leaves behind enough wealth to cover the installments until their maturity, then in that case, their coming of age will be waited for. After reaching maturity, if they pay the remainder of the contract of manumission, they will become free, and if they are unable to do so, they will become slaves.

Imam Malik, may Allah have mercy on him, said that if a mukatab dies and leaves behind wealth that is not sufficient to cover the price of his manumission, and he leaves behind his children and an umm walad who was included in the contract of manumission, then if the umm walad wishes to take that wealth and work hard along with the children to earn their freedom, if the umm walad is trustworthy and capable of bearing the hardship of labor, then the wealth should be handed over to her. Otherwise, the master will take the wealth, and the umm walad and the children of the mukatab will become slaves of the master.

It is narrated from Rabi'ah bin Abi Abdur Rahman and others that Farafisah bin Umair had a mukatab (contracted slave), who brought the entire amount of his contract before the appointed time. Farafisah refused to accept it. The mukatab went to Marwan, who was the governor of Madinah, and informed him of the matter. Marwan summoned Farafisah and said: "Take the amount of the contract." Farafisah refused. Marwan ordered that the money be taken from the mukatab and placed in the public treasury (Bayt al-Mal), and said to the mukatab: "Go, you are free." When Farafisah saw this situation, he took the money.

Imam Malik, may Allah have mercy on him, said: In our view, the ruling is that if a mukatab pays all his installments before the due time, it is valid, and his master does not have the right to refuse to accept it, because by this, the master removes every condition and service from his responsibility. This is because a person's freedom is not complete until his sanctity is fully established, his testimony becomes permissible, he becomes entitled to inheritance, and it is not appropriate for his master to impose any condition of work or service upon him after his freedom.

Imam Malik, may Allah have mercy on him, said that if a mukatab becomes seriously ill, and he wishes to pay all the installments to his master and become free so that his heirs, who are already free, may inherit from him and are not included in his contract of manumission, then this is permissible for the mukatab. This is because his sanctity is thus fulfilled, his testimony is valid, the acknowledgment of debts he makes to people is valid, his will is valid, and his master cannot object on the grounds that he wants to save his wealth.

Hazrat Saeed bin Musayyib was asked: If a mukatab (contracted slave) is shared between two men, and one of them frees his share, then the mukatab dies and leaves behind a lot of wealth, what is the ruling? Saeed said: The one who did not free (his share) will take the compensation for his share of the contract, and whatever remains after that will be divided between the two men.

Imam Malik, may Allah have mercy on him, said that when a mukatab becomes free, his heir will be the person who made him a mukatab, or the closest male relative among the mukatab's relatives on the day the mukatab dies, whether it is a son or another 'asaba (male agnate).

Imam Malik, may Allah have mercy on him, said that in this way, if a person is set free, then his inheritance will go to the closest relative of the one who set him free, whether it is a son or any other male agnate, on the day that the slave died.

Imam Malik, may Allah have mercy on him, said that if several brothers are collectively made mukatab, and they have no children who were born during the period of the contract of mukatabah, or who entered into the contract of mukatabah, then those brothers will inherit from one another. If any of them has a son who was born during the period of the contract of mukatabah, or upon whom the contract of mukatabah was enacted and he dies, then first, from his wealth, the total amount of the contract of mukatabah will be paid, and whatever remains will go to his children, not to his brothers.

Condition in the Mukatab contract

Hadith Number: 1300Q1
Imam Malik, may Allah have mercy on him, said that if a person makes his slave a mukatab (one who has a contract for freedom) for gold or silver, and sets a condition in the contract such as travel, service, or sacrifice, but specifies this condition, then if the mukatab becomes able to pay his installments before the due time and pays them, but this condition still remains upon him, he will become free, and his sanctity will be complete. Now, regarding this condition, if it is such that the mukatab himself has to fulfill it (like the condition of travel or service), then it will not be obligatory upon the mukatab, nor will the master have the right to demand its fulfillment. And if the condition is such that something has to be given, like the condition of sacrifice or clothing, then it will be like the dirhams and dinars; the value of that thing will be assessed and he will pay it along with his installments. Until he pays it, he will not be free.
