He said: That is because the Messenger of Allah, peace and blessings be upon him, "settled with a choice four-year-old camel in place of a young camel he had borrowed." And that Abdullah ibn Umar borrowed dirhams and repaid better than them. So if that is done out of the borrower’s goodwill, and it is not based on a condition, nor a promise, nor a custom, then it is permissible and there is no harm in it.

Imam Malik (may Allah have mercy on him) was informed that someone said to Sayyiduna Umar bin Khattab (may Allah be pleased with him): A person lends grain to someone on the condition that it will be repaid in such-and-such city. He considered this disliked and said: Where will the cost of transportation go?

A man came to Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) and said: I lent a man some money and stipulated that he return it with something better. Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) said: This is riba (usury). He said: Then what do you command? Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) said: There are three types of loans: one is for the sake of Allah, in which there is Allah’s pleasure; one is for the happiness of your friend, in which there is your friend’s pleasure; and one is a loan in which you give lawful wealth and take unlawful wealth in return, and this is usury. Then the man said: Now what do you command me, O Abu Abdur Rahman? He said: In my view, it is appropriate that you tear up the document. If the person to whom you lent the money gives you back the same as you gave, then take it. If he gives you something worse and you take it, you will have a reward. If he, of his own accord, gives you something better, then he has thanked you, and you will have the reward for the time you gave him respite.

Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) used to say: Whoever gives someone a loan should not stipulate any condition except the repayment of the loan.

Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) used to say: Whoever gives a loan to someone, let him not stipulate anything extra from him, even if it is a handful of grass, for that is riba.

Imam Malik, may Allah have mercy on him, said: In our view, it is unanimously agreed that if a person lends an animal whose appearance and characteristics are known, there is no objection; the debtor should return an animal of the same kind. However, it is not permissible to lend a slave-girl, because this is a means of making the unlawful lawful. People would borrow each other's slave-girls, then have intercourse with them as long as they wished, and then return them to the owner. This is not lawful. The people of knowledge have always prohibited this and have never permitted it to anyone.

It is narrated from Sayyiduna Abu Huraira (may Allah be pleased with him) that the Messenger of Allah (peace and blessings of Allah be upon him) said: "Do not meet traders on the way to buy their goods before they reach the market, and none of you should sell over the sale of his brother, and do not practice najsh (artificially inflating prices), and a townsman should not sell on behalf of a villager, and do not collect milk in the udders of camels and goats (i.e., do not withhold milking to deceive buyers). If someone buys such a she-camel or goat, and after milking it comes to know of the situation, then the buyer has the option: if he wishes, he may keep it, or if he wishes, he may return it, and in exchange for the milk, he should give one sa‘ (measure) of dates."

Imam Malik, may Allah have mercy on him, said that regarding the saying of the Messenger of Allah, peace and blessings be upon him: "None of you should sell over the sale of his brother," it means that a person should not make an offer over the offer of another when the seller has already agreed to the first offer, has started weighing his goods, and has begun to declare himself free from defects, or does any other act which shows that the seller has accepted the first offer. But if the seller has not agreed to the first offer and has kept the goods for sale as before, then it is permissible for anyone to make an offer. And if, as soon as one person makes an offer, others are prohibited from making offers, then this would be a loss for the seller.

Malik said: There is no harm in bidding on a commodity that is put up for sale, and more than one person bids on it. He said: And if people were to stop bidding at the first person who bids on it, it would be taken for a price close to falsehood, and something disliked would enter upon the sellers regarding their goods. And the matter has always been thus among us.
