Comprehensive Chapter on Judgment and Its Dislike
Hadith Number: 1474B1
Imam Malik, may Allah have mercy on him, said that if a person takes help from another's slave in a major task without the owner's permission, for which it is necessary to hire a servant or call a laborer, and the slave suffers any defect because of performing that work, then liability will be obligatory upon him. And if the slave remains safe and sound and his master demands wages, then wages will have to be paid.

Hadith Number: 1474B2
Imam Malik, may Allah have mercy on him, said that if a slave is partially free and partially still owned (a slave), then his wealth will remain with him; nothing new can be done with it, rather, he may eat and drink from it as needed. Then, when he dies, that wealth will go to the one whose ownership remained.

Imam Malik, may Allah have mercy on him, said that from the day the boy becomes wealthy, the father may, if he wishes, calculate from that day what he has spent on him and take reimbursement from him, whether the boy's wealth is in the form of cash or in the form of goods.

Hadith Number: 1475
Hazrat Umar bin Abdur Rahman bin Dalaf Muzani narrates from his father that a man from the tribe of Juhaina (Asayfa) used to go ahead of all the pilgrims and buy good and expensive camels, and he used to travel quickly, so he would reach before all the pilgrims. Once he became bankrupt and his case came before Sayyiduna Umar (may Allah be pleased with him). He (may Allah be pleased with him) said: After praise and salutations, let it be known to the people that Asayfa, who is from the tribe of Juhaina, also liked the matter of religion and trustworthiness, so that people would say about him that he reached before all the pilgrims. Be aware that he bought on credit, did not think about repayment, so he became bankrupt, and the debt overwhelmed his wealth. So whoever has a debt upon him should come to us in the morning, we will distribute his wealth among the creditors. You people should avoid taking loans; as soon as you take a loan, there is distress, and in the end, there is conflict.

What is Reported Regarding What Slaves Spoil or Injure
Hadith Number: 1476Q1
Imam Malik, may Allah have mercy on him, said: In our view, the Sunnah regarding the offense of a slave is that if a slave injures someone, or takes away someone’s property, or cuts fruit from someone’s tree, or steals something for which his hand is not to be cut off, then the slave’s person (his neck, i.e., his freedom or slavery) becomes liable for it. The master (owner) has the choice: if he wishes, he may pay the value of those things or the blood money for the injury and keep his slave, or if he wishes, he may hand over the slave himself to the victim of the offense. The master will not be required to pay more than the value of the slave, even if the value of the thing or the blood money is more than the value of the slave.

What is Permissible in Gifts
Hadith Number: 1476
It is narrated from Sa'id bin al-Musayyib that Sayyiduna Uthman bin Affan, may Allah be pleased with him, said: If a person gives something as a gift to his minor son, it is valid, provided he gives it openly and appoints witnesses to it. Then the guardian will remain the father himself (he will retain possession of that thing on behalf of the boy until the boy reaches maturity).

Hadith Number: 1476B1
Imam Malik, may Allah have mercy on him, said: In our view, the ruling is that if a person gives gold or silver to his minor child, and then that child dies while the father was his guardian, then that wealth will not be considered as belonging to the child, except in the case where the father had separated that wealth or deposited it with someone else; then it will belong to the son (and now that wealth will reach all the son's heirs according to the shares prescribed).
