Imam Malik, may Allah have mercy on him, said that if the grandfather and his brothers and sisters are present along with any of the possessors of fixed shares (dhawi al-furud), then first the possessors of fixed shares will be given their prescribed shares. After that, whatever remains, one of several options will be chosen for the grandfather, whichever is better for him. These options are: one is that the grandfather is given one third of whatever wealth remains. The second is that the grandfather is considered as one of the brothers, and he receives the same share as one brother. The third is that he is given one sixth of the total wealth. Whichever of these options is better for him, that will be done. After giving the grandfather his share, whatever wealth remains will be divided among the brothers and sisters as «﴿لِلذَّكَرِ مِثْلُ حَظِّ الْأُنثَيَيْنِ﴾» , except in one case where the division will be done differently (this is called the Mas’alah Akdariyyah). That is: if a woman dies and leaves behind a husband, mother, full sister, and grandfather, then the husband will get half, the mother one third, the grandfather one sixth, and the full sister half. Then the grandfather’s one sixth and the sister’s half will be combined and divided into three parts: two parts will go to the grandfather and one part to the sister.

Imam Malik, may Allah have mercy on him, said: If there are paternal half-brothers along with the grandfather, their ruling is the same as that of full brothers. And when there are full brothers and sisters as well as paternal half-brothers and sisters, the paternal half-siblings will only be counted among the brothers to reduce the grandfather’s share, but they will not receive anything. However, in the case where there are maternal siblings along with full brothers and sisters, the maternal siblings will not be counted among the brothers to reduce the grandfather’s share, because maternal brothers and sisters are deprived in the presence of the grandfather. If the grandfather is present and only maternal siblings are there, then the entire estate goes to the grandfather and the maternal siblings are deprived. Now, in the case where there are full brothers and sisters and paternal half-brothers and sisters along with the grandfather, whatever remains after giving the grandfather his share will go entirely to the full brothers and sisters. The paternal half-siblings will not receive anything, except when among the full siblings there is only one sister and the rest are all paternal half-brothers and sisters, then due to the paternal half-brothers and sisters, that full sister will reduce the grandfather’s share, then she will take her full share, that is, half. If anything remains after that, it will be distributed among the paternal half-brothers and sisters as per «﴿لِلذَّكَرِ مِثْلُ حَظِّ الْأُنثَيَيْنِ﴾» , and if nothing remains, then the paternal half-brothers and sisters will not receive anything.

It is narrated from Sayyiduna Qabisah bin Dhuwayb (may Allah be pleased with him) that the maternal grandmother of a deceased person came to Sayyiduna Abu Bakr as-Siddiq (may Allah be pleased with him) to claim inheritance. Sayyiduna Abu Bakr as-Siddiq (may Allah be pleased with him) said: "There is no prescribed share for you in the Book of Allah, nor have I heard any hadith from the Messenger of Allah (peace and blessings of Allah be upon him) regarding this matter. So go back, and I will inquire from the people." Sayyiduna Abu Bakr as-Siddiq (may Allah be pleased with him) asked the people, and Sayyiduna Mughirah bin Shu’bah (may Allah be pleased with him) said: "I was present at that time; in my presence, the Messenger of Allah (peace and blessings of Allah be upon him) allotted the grandmother one-sixth." Sayyiduna Abu Bakr (may Allah be pleased with him) said: "Is there anyone else with you (who knows about this matter)?" Then Sayyiduna Muhammad bin Maslamah al-Ansari (may Allah be pleased with him) stood up and narrated just as Sayyiduna Mughirah bin Shu’bah (may Allah be pleased with him) had said. Sayyiduna Abu Bakr (may Allah be pleased with him) allotted her one-sixth. Then, during the time of Sayyiduna Umar (may Allah be pleased with him), a paternal grandmother came to claim inheritance. Sayyiduna Umar (may Allah be pleased with him) said: "There is no share for you mentioned in the Book of Allah, and the previous ruling was regarding the maternal grandmother, and I cannot add anything to the prescribed shares from myself. But you too may take the same one-sixth; if both grandmothers are present, then both should share the one-sixth, and if only one of you is present (i.e., only the maternal or only the paternal grandmother), then she alone should take the one-sixth."

It is narrated from Qasim bin Muhammad that both the maternal and paternal grandmothers came to Sayyiduna Abu Bakr Siddiq (may Allah be pleased with him). Sayyiduna Abu Bakr Siddiq (may Allah be pleased with him) intended to give the maternal grandmother one-sixth share. An Ansari man said: O Sayyiduna Abu Bakr Siddiq (may Allah be pleased with him)! You are not giving it to the one who, if she died and the deceased was alive, that is, her grandson, would inherit (and you are giving it to the one who, if she died and the deceased was alive, that is, her daughter's son, would not inherit). Then, after hearing this, Sayyiduna Abu Bakr Siddiq (may Allah be pleased with him) gave one-sixth share to both of them.

Hazrat Abu Bakr bin Abdur Rahman would not allot a share except to the maternal grandmother or the paternal grandmother.

Imam Malik, may Allah have mercy on him, said: According to us, this is the ruling in which there is no difference of opinion, that the maternal grandmother will not receive anything while the mother is present; however, if the mother is not present, she will receive one-sixth. And the paternal grandmother will not receive anything while the mother or the father is present; when both the mother and father are not present, she will receive one-sixth. If both the maternal and paternal grandmothers are present and the deceased's parents, who are closer than the grandmothers, are not present, then among them, if the maternal grandmother is closer to the deceased, she alone will receive one-sixth (1), and if the paternal grandmother is closer (2) or both are equally close (3), then both will share the one-sixth.

Imam Malik, may Allah have mercy on him, said: There is no inheritance for anyone among the grandmothers except the mother’s mother, no matter how far she may be (1); apart from her, no other maternal (2) or paternal (3) grandmother is allotted inheritance. Because the Messenger of Allah, peace and blessings be upon him, allotted inheritance to the maternal grandmother, then Sayyiduna Abu Bakr, may Allah be pleased with him, also inquired about it, and when it became known to him that the Messenger of Allah, peace and blessings be upon him, allotted inheritance to the maternal grandmother, he did so as well. After that, the paternal grandmother came during the time of Sayyiduna Umar, may Allah be pleased with him. He said: I cannot increase the prescribed shares, but if you and the maternal grandmother are both present, then both of you should share the one-sixth, and if any one of you is alone, then she should take the full one-sixth (4).

Imam Malik, may Allah have mercy on him, said: Since the beginning of Islam until today, no one has allotted inheritance to any kind of grandmother except these maternal and paternal grandmothers.

Malik said: The agreed-upon matter among us, in which there is no difference, and upon which I found the people of knowledge in our city, is that the maternal grandmother does not inherit anything along with the mother, and in other than that, one-sixth is prescribed for her as an obligatory share. And that the paternal grandmother does not inherit along with the mother, nor with the father, anything. And in other than that, one-sixth is prescribed for her as an obligatory share. So if the two grandmothers, the paternal grandmother and the maternal grandmother, are present, and the deceased has neither a father nor a mother besides them, Malik said: I have heard that if the maternal grandmother is closer, she receives the one-sixth, to the exclusion of the paternal grandmother. And if the paternal grandmother is closer, or if they are equally close to the deceased, then the one-sixth is divided between them, half and half.

Malik said: There is no inheritance for any of the grandmothers except for the two grandmothers, because it has reached me that the Messenger of Allah, peace and blessings be upon him, gave inheritance to the grandmother. Then Abu Bakr inquired about that until reliable information from the Messenger of Allah, peace and blessings be upon him, came to him that he gave inheritance to the grandmother, so he implemented it for her. Then the other grandmother came to Umar ibn al-Khattab, and he said to her: I will not add anything to the prescribed shares. So if you both are present, it is between you, and whichever of you is alone with it, it is for her.

Inheritance of the Kalalah (person with no parents or children)
It is narrated from Hazrat Zaid bin Aslam that Sayyiduna Umar bin Khattab, may Allah be pleased with him, asked the Messenger of Allah, peace and blessings be upon him, about kalalah. The Prophet, peace and blessings be upon him, said: "The verse that was revealed in the summer, at the end of Surah An-Nisa, is sufficient for you."

Imam Malik, may Allah have mercy on him, said: In our view, there is no difference of opinion in this matter that there are two types of kalalah. One is the verse that is at the beginning of Surah An-Nisa, where Allah Almighty said: "If a man dies as kalalah or a woman dies as kalalah and he has a brother or a sister (from the mother), then each of them shall receive a sixth; but if they are more than that, then they shall share in a third." This is the kalalah who has neither a father nor offspring, because until then, maternal brothers and sisters were not heirs. The second is the verse at the end of Surah An-Nisa, where Allah Almighty said: "They ask you about kalalah (inheritance), say: Allah gives you a ruling concerning kalalah: If a man dies and has no child, and he has a sister, she will have half of what he leaves; and he will inherit from her if she has no child. If there are two sisters, they will have two-thirds of what he leaves. If there are brothers and sisters, the male will have the share of two females. Allah makes clear to you, lest you go astray. Allah knows all things." This is the kalalah in which brothers and sisters become 'asabah (residuary heirs). When the deceased has no son, then with the grandfather, they will inherit in kalalah.
