Those Who Spoke Regarding a Woman Who Apostatizes from Islam

٣٤٩٧١ - حدثنا حفص عن ليث عن عطاء في المرتدة قال: لا تقتل.
Hazrat Laith (may Allah have mercy on him) says that Hazrat Ata (may Allah have mercy on him) stated regarding an apostate woman: that she will not be killed.

٣٤٩٧٢ - حدثنا حفص عن (عمرو) (١) عن الحسن قال: لا تقتل.

Hazrat Amr (may Allah have mercy on him) says that Hasan (may Allah have mercy on him) said: A woman who becomes an apostate will not be killed.

٣٤٩٧٣ - حدثنا عبد الرحيم بن سليمان عن اشعث عن الحسن قال: لا تقتل النساء إذا هن ارتددن عن الإسلام، ولكن يدعين إلى الإسلام فإن هن ابين سبين، وجعلن إماء للمسلمين ولا يقتلن.
Hazrat Ash'ath (may Allah have mercy on him) narrates that Hasan (may Allah have mercy on him) said: When women apostatize from Islam, they should not be killed. Rather, they should be invited to Islam. If they refuse, they should be imprisoned and made bondwomen of the Muslims, and they should not be killed.

٣٤٩٧٤ - حدثنا ابو داود عن ابي حرة عن الحسن في المراة ترتد عن الإسلام قال: لا تقتل، تحبس.
Hazrat Abu Hurrah, may Allah have mercy on him, states that Hasan, may Allah have mercy on him, said regarding the woman who apostatizes from Islam: She will not be killed; she will be imprisoned.

٣٤٩٧٦ - حدثنا عبد الله بن إدريس عن هشام عن (الحسن) (١) في المرتدة تستتاب، فإن تابت وإلا قتلت.

Hazrat Hisham (may Allah have mercy on him) narrates that Hasan (may Allah have mercy on him) said regarding an apostate woman: She will be asked to repent. If she repents, then fine; otherwise, she will be killed.

٣٤٩٧٧ - حدثنا وكيع عن سفيان عن يحيى بن سعيد عن عمر بن عبد العزيز ان ام ولد رجل من المسلمين ارتدت فباعها بدومة الجندل من غير اهل دينها.
Hazrat Yahya bin Saeed (may Allah have mercy on him) narrates that Hazrat Umar bin Abdul Aziz (may Allah have mercy on him) said: A man's umm walad from among the Muslims became an apostate. So that man sold her at the place of Dumah al-Jandal to a person of a religion different from hers.

٣٤٩٧٨ - حدثنا وكيع قال: ثنا سفيان عن ابي معشر عن إبراهيم في المراة ترتد عن الإسلام، قال: تستتاب، فإن تابت وإلا قتلت.
Hazrat Abu Ma'shar (may Allah have mercy on him) says that Ibrahim (may Allah have mercy on him) gave the following ruling regarding a woman who apostatizes from Islam: She will be asked to repent. If she accepts repentance, then fine; otherwise, she will be killed.

٣٤٩٧٩ - حدثنا محمد بن بشر قال: ثنا سعيد عن ابي معشر عن إبراهيم بنحو منه.
This statement of Ibrahim (may Allah have mercy on him) is also narrated from Abu Ma'shar (may Allah have mercy on him) through this chain of transmission.

٣٤٩٨٠ - حدثنا حفص عن حجاج عن الحكم قال: كان اهل العلم (يقولون) (١): إذا آمن المحارب لم يؤخذ بشيء كان اصابه في حال حربه إلا ان يكون شيئا اصابه قبل ذلك.

Hazrat Hakam (may Allah have mercy on him) says that the scholars used to say: When a combatant is granted amnesty, the wealth he acquired during the state of war will not be taken from him. However, the wealth he acquired before the war will be taken from him.
