Hazrat Shurayh (may Allah have mercy on him) says that Urwah Barqi came to me from Hazrat Umar (may Allah be pleased with him) and said that if a person gives his wife three divorces in the state of death-illness, then if the woman is in her waiting period at the time of his death, she will be his heir. However, the man will not be the woman's heir.

Ibrahim (may Allah have mercy on him) said that as long as a woman is in her waiting period (‘iddah), she will inherit from her husband, but he will not inherit from her.

Hazrat Ja'far, may Allah have mercy on him, narrates from his father that Hazrat Hasan bin Ali, may Allah be pleased with him, divorced his wife during his terminal illness, and then she became his heir.

Hazrat Shurayh (may Allah have mercy on him) says that if a man divorces his wife during his death illness, then if the woman is in her waiting period at the time of the man's death, she will be an heir.

Hazrat Sha’bi (may Allah have mercy on him) narrates that Umm Baneen bint ‘Uyaynah bin Hisn was married to Hazrat ‘Uthman bin ‘Affan (may Allah be pleased with him). When Hazrat ‘Uthman (may Allah be pleased with him) was besieged in the house of caliphate, he divorced Umm Baneen. He used to send messages to her to buy her share from her, but she refused. After the martyrdom of Hazrat ‘Uthman, Umm Baneen mentioned this matter to Hazrat ‘Ali (may Allah be pleased with him), so he said: He left her, and then when death approached, he divorced her and made her an heir.

Hazrat Sha’bi (may Allah have mercy on him) narrates that Hazrat Hisham bin Hubairah (may Allah have mercy on him) wrote a letter to Hazrat Shurayh (may Allah have mercy on him) in which he asked: If a person gives his wife three divorces during his death illness, will she inherit from him? He replied: He wants to escape from the Book of Allah; she will inherit from him.

Hazrat Tawus (may Allah have mercy on him) says that if a person, during his terminal illness, gives his wife three divorces, and if the man passes away during her waiting period (‘iddah), then she will be his heir.

Hazrat Hisham (may Allah have mercy on him) says that I asked Hazrat Urwah whether, if a person gives his wife an irrevocable divorce, will they inherit from each other? And will the woman receive maintenance? He replied that they will not inherit from each other, and the woman will also not receive maintenance. However, if she is pregnant, she will receive maintenance. The man will spend on her until the child is born. Similarly, if the divorce is given during a terminal illness to harm the woman, the same ruling applies.

Hazrat Aisha (may Allah be pleased with her) says that if a man gives his wife three divorces during his death illness, and if the man passes away during her waiting period, then the woman will be an heir.

Hazrat Ibn Sirin (may Allah have mercy on him) said that the people of knowledge used to say: "Do not dispute. Whoever flees from the Book of Allah will be returned to it." That is, the person who divorces his wife while in his death illness.
