كِتَابُ وِلَايَةِ الْعَصَبَةِ
Book of Agnatic Guardianship ('Asabah)
بَابُ مَنْ أَسْلَمَ عَلَى الْمِيرَاثِ قَبْلَ أَنْ يُقْسَمَ
Chapter on one who accepts Islam before the inheritance is distributed
Hadith Number: 193
نا سفيان ، عن عمرو بن دينار ، ان رسول الله صلى الله عليه وسلم , قال: " كل ميراث قسم في الجاهلية فهو على قسم الجاهلية، وكل ميراث لم يقسم حتى ادركه الإسلام فهو على قسم الإسلام" .
The Messenger of Allah, peace and blessings be upon him, said: "Whatever inheritance was distributed in the time of ignorance will be according to the principles of ignorance, and whatever came in Islam will be distributed according to the principles of Islam."

Hadith Number: 194
نا سفيان ، عن عمرو بن دينار ، عن عوسجة ، عن ابن عباس , ان رجلا مات على عهد رسول الله صلى الله عليه وسلم، وليس له وارث إلا غلام له هو اعتقه، فاعطاه رسول الله صلى الله عليه وسلم ميراثه" .
Ibn Abbas (may Allah be pleased with them) said: "A man died during the time of the Prophet (peace and blessings be upon him), and he had no heir except for a slave whom he had freed. The Messenger of Allah (peace and blessings be upon him) made him the heir."

Hadith Number: 195
نا نا سفيان، عن عمرو بن دينار، عن عطاء، قال:" مات قين في خط بني جمح ولم يترك قرابة إلا عبدا هو اعتقه، فامر عمر ان يعطى المال" .
Sayyiduna Umar (may Allah be pleased with him) gave an order regarding a person who had freed his slave that: "He should be given wealth."

Hadith Number: 196
نا إسماعيل بن عياش ، عن ابن جريج ، عن عطاء ، قال: قضى رسول الله صلى الله عليه وسلم: " ان كل ميراث قسم في الجاهلية فهو على قسمة الجاهلية، وما ادرك الإسلام من ميراث فهو على قسمة الإسلام" .
The Messenger of Allah ( صلی اللہ علیہ وسلم ) ruled that: "The inheritance divided in the time of ignorance will remain upon ignorance, and the Islamic inheritance will be upon Islam."

Hadith Number: 197
نا إسماعيل بن عياش ، عن عبد العزيز بن عبيد الله ، عن زائدة بن عبد الرحمن اخي بني ساعدة" ان رسول الله صلى الله عليه وسلم قضى بذلك فيهم" .
The Messenger of Allah (peace and blessings be upon him) gave a verdict regarding them that: "The inheritance will be according to Islamic principles."

نا هشيم، قال: انا إسماعيل بن ابي خالد، عن الشعبي، قال: " من تولى قوما فهو منهم" .
Shu'bi (may Allah have mercy on him) said: "Whoever associates himself with a people, he is one of them."

نا هشيم، قال: انا يونس، عن الحسن، قال: " من انتحل دينا فهو من اهله" .
Hasan al-Basri (may Allah have mercy on him) said: "Whoever adopts a religion will be counted among its people."

نا عيسى بن يونس ، قال: نا معاوية بن يحيى الصدفي ، عن القاسم الشامي ، عن ابي امامة ، قال: قال رسول الله صلى الله عليه وسلم: " من اسلم على يديه رجل فله ولاؤه" .
The Messenger of Allah, peace and blessings be upon him, said: "Whoever causes a person to become Muslim at his hands, then his wala’ (allegiance) is for him."

Hadith Number: 201
نا عيسى بن يونس ، قال: نا الاحوص بن حكيم ، عن راشد بن سعد ، قال: قال رسول الله صلى الله عليه وسلم: " من اسلم على يديه رجل فهو مولاه يرثه، ويدي عنه" .
The Messenger of Allah, peace and blessings be upon him, said: "Whoever accepts Islam at the hand of someone, that person is his mawla (protector), he will be his heir, and he will pay his blood money."

Hadith Number: 202
نا إسماعيل بن عياش ، قال: نا الاحوص بن حكيم ، عن راشد بن سعد ، قال: سئل رسول الله صلى الله عليه وسلم عن الرجل يسلم على يدي الرجل قال:" هو اولى الناس به يرثه ويعقل عليه" .
It was asked from the Messenger of Allah ( صلی اللہ علیہ وسلم ) that if a person accepts Islam at the hand of someone, he ( صلی اللہ علیہ وسلم ) said: "He is the most entitled to him, he will be his heir, and he will pay his blood money."
