Book of Agnatic Guardianship ('Asabah)
بَابُ مَنْ أَسْلَمَ عَلَى الْمِيرَاثِ قَبْلَ أَنْ يُقْسَمَ
Chapter on one who accepts Islam before the inheritance is distributed
Hadith Number: 203
نا إسماعيل بن عياش ، قال: حدثني عبد العزيز بن عمر بن عبد العزيز ، عن عبد الله بن موهب قاضي فلسطين، عن تميم الداري ، قال: سالت رسول الله صلى الله عليه وسلم عن الرجل يسلم على يدي الرجل، فقال رسول الله صلى الله عليه وسلم:" هو اولى الناس بمحياه ومماته" .
Sayyiduna Tamim Dari (may Allah be pleased with him) says: I asked the Messenger of Allah (peace and blessings be upon him): "What about the person who accepts Islam at someone’s hand?" He replied: "He is the most entitled to him in his life and in his death."

Hadith Number: 204
نا ابو عوانة، عن منصور، قال: سالت إبراهيم عن النبطي يسلم فيوالي الرجل قال:" يرثه ويعقل عنه" .
Mansur (may Allah have mercy on him) says: I asked Ibrahim Nakha'i (may Allah have mercy on him) about a Christian who accepts Islam at the hand of someone, so he said: "He will be his heir and will pay his blood money."

نا هشيم، قال: انا ابو مالك الكوفي، عن إبراهيم النخعي، انه كان يقول: " إن عقل عنه ورثه، وإن لم يعقل عنه لم يرثه" .
Ibrahim Nakha'i (may Allah have mercy on him) said: "If someone pays blood money, then he will be the heir, and if he does not pay, then he will not be the heir."

Hadith Number: 206
نا هشيم، قال: انا مطرف، عن الشعبي، قال: سئل عن الرجل، يسلم على يدي الرجل، ايرثه؟ قال:" لا ولا، إلا لذي نعمة، ماله للمسلمين، وعقله اراه عليهم" .
It was asked from Sha'bi (may Allah have mercy on him) that if a person accepts Islam at someone's hand, will he be his heir? He replied: "No, except for the one who has done a favor; otherwise, his wealth will belong to the Muslims and the blood money will be upon them."

نا هشيم، قال: انا يونس، عن الحسن، قال: " لا، إلا لذي نعمة" .
Hasan al-Basri (may Allah have mercy on him) said: "No, except for the one upon whom favor is shown."

نا نا إسماعيل بن عياش، قال: سالت إسحاق بن عبد الله بن ابي فروة عن الرجل يسلم على يدي الرجل، فقال اخبرني عمرو بن شعيب، ان عمر بن الخطاب كتب إلى عمرو بن العاص" إنك كتبت تسالني عن قوم دخلوا في الإسلام فماتوا. قال: ترفع اموال اولئك إلى بيت مال المسلمين. وكتبت تسالني عن الرجل يسلم فيعاد القوم ويعاقلهم، وليس له فيهم قرابة ولا لهم عليه نعمة، فاجعل ميراثه لمن عاقل وعاد" .
Ismail bin Ayash says: I asked Ishaq bin Abdullah, and he said: Sayyiduna Umar bin Khattab (may Allah be pleased with him) wrote to Amr bin al-As (may Allah be pleased with him) that: "Those who accepted Islam secretly and died, their wealth will go to the Bayt al-Mal (public treasury), and whoever joins a people and sheds blood with them, and has no relation or favor with them, then give his inheritance to them."

نا إسماعيل بن عياش، عن عبد العزيز بن عمر بن عبد العزيز، ان عمر بن عبد العزيز" قضى في رجل من اولئك هلك وترك ابنته وبني مواليه، فجعل الميراث بين ابنته وبين بني مواليه" .
Umar bin Abdul Aziz (may Allah have mercy on him) gave a verdict regarding a man who left behind a daughter and a slave, so the inheritance was divided between the daughter and the slaves.

Hadith Number: 211
نا نا إسماعيل بن عياش، عن عبد العزيز بن عبيد الله الشعبي، والحكم بن عتيبة" في الرجل يسلم فيوالي قوما ان لهم ميراثه وجنايته عليهم" .
Shu'bi and Hakam bin 'Utaybah (may Allah have mercy on them) used to say: "Whoever accepts Islam along with a people, then for them is his inheritance and blood money."

نا إسماعيل بن عياش، عن عبد العزيز بن عبيد الله، عن الشعبي، عن مسروق، عن ابن مسعود ، مثله.
Shu'bi (may Allah have mercy on him) narrates from Masruq (may Allah have mercy on him), and he from Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) in the same manner.
