بَابُ مَا جَاءَ فِي الْإِيلَاءِ
Chapter: What is reported regarding ila' (oath of abstention from wife)
Hadith Number: 1458
نا حماد بن زيد، عن منصور، عن إبراهيم , في رجل آلى من امراته فمضت اربعة اشهر، او اختلعت منه فتزوجها في عدتها فطلقها قبل ان يدخل بها , قال: كان إبراهيم يقول:" لها الصداق تاما ويستقبل العدة" ، وكان الحسن , وعامر , يقولان:" لها نصف الصداق وتكمل ما بقي من عدتها"، فقلت لمنصور: اي القولين احب إليك؟ قال: قول الحسن , وعامر.
A man made an oath of abstinence (ila) from his wife, four months passed or he divorced her through khul', then during her waiting period ('iddah) he married her again, but divorced her before seclusion (khalwah). Ibrahim (may Allah have mercy on him) said: She is entitled to the full dowry (mahr) and the waiting period ('iddah) will start anew. Hasan al-Basri and 'Amir (may Allah have mercy on them both) said: She will receive half the dowry and will complete the remaining waiting period. Mansur was asked: Which opinion do you prefer? He said: The opinion of Hasan and 'Amir.

Hadith Number: 1459
حدثنا حماد بن يزيد، عن ابي عبد الله الشقري، عن إبراهيم،" في المولى عنها والمطلقة إذا خطبها زوجها في عدتها , ثم طلقها قبل ان يدخل بها، فلها المهر كاملا وبانت العدة" .
Ibrahim (may Allah have mercy on him) said: If, after an oath of abstinence or divorce, the husband marries his wife during her waiting period and divorces her before seclusion, then the full dowry is due and the waiting period ends.

Hadith Number: 1460
حدثنا هشيم، نا مغيرة، عن إبراهيم، انه كان يقول: " إذا تزوج امراته وهو في عدة من الخلع او إيلاء فطلقها قبل ان يدخل بها فلها , الصداق تاما، ولها العدة تامة" .
Ibrahim (may Allah have mercy on him) said: If, during the waiting period (‘iddah) of khul‘ or ila’, a marriage is contracted and then divorce is given without seclusion (khalwah), the full dowry (mahr) and the complete waiting period (‘iddah) will be obligatory.

حدثنا هشيم، انا عبد الله بن سبرة الهمداني، عن الشعبي، قال مثل ذلك.
This same statement is also narrated from Hazrat Sha'bi (may Allah have mercy on him).

حدثنا هشيم، نا حجاج، ومحمد بن سالم، عن الشعبي، مثل ذلك.
The same narration is reported from Al-Sha'bi (may Allah have mercy on him) through Muhammad bin Salim and Hajjaj as well.

Hadith Number: 1463
حدثنا حجاج، عن عطاء، قال: " لها بقية الصداق وتكمل ما بقي من عدتها" .
Hazrat Ata (may Allah have mercy on him) said: The remaining dowry will be given and the waiting period (‘iddah) will be completed.

Hadith Number: 1464
حدثنا هشيم، نا يونس، ومنصور، عن الحسن، انه كان يقول مثل ما قال عطاء.
The same statement is also narrated from Hasan al-Basri (may Allah have mercy on him), just as it is the saying of Ata (may Allah have mercy on him).

Hadith Number: 1465
حدثنا عتاب بن بشير، نا خصيف، عن الحكم، وزياد بن ابي مريم، قالا: " إذا طلق الرجل امراته طلاقا بائنا، وقد كان دخل بها فتزوجها في عدتها من الطلاق، ثم طلقها قبل ان يدخل بها , كان لها المهر كاملا، وإن تزوجها بعد انقضاء عدتها فلها نصف المهر" .
Hazrat Hakam and Ziyad bin Abi Maryam (may Allah have mercy on them) said: If a man gives a woman an irrevocable divorce and marries her during her waiting period, then divorces her without seclusion, she will receive the full dowry. And if he marries her after the waiting period, she will receive half the dowry.

Hadith Number: 1466
حدثنا عتاب، عن خصيف، قال: كان ميمون بن مهران , يقول: " لها نصف المهر تزوجها في العدة او بعد العدة" .
The statement of Hazrat Maymun bin Mehran (may Allah have mercy on him) is: Whether the marriage takes place during the waiting period or after the waiting period, the woman will receive half the dowry.

Hadith Number: 1467
حدثنا حدثنا فرج بن فضالة ، حدثني علي بن ابي طلحة ، عن ابن عون الاعور، عن ابي الدرداء ، قال: " المختلعة يلحقها الطلاق ما دامت في العدة" .
It is narrated from Sayyiduna Abu Darda (may Allah be pleased with him) that: Divorce takes effect upon a woman who has sought khul‘ during her ‘iddah.
