كِتَابُ الطَّلَاقِ
Book of Divorce
بَابُ الرَّجُلِ يَجْعَلُ أَمْرَ امْرَأَتِهِ بِيَدِهَا
Chapter on a man giving his wife the right to decide
Hadith Number: 1643
نا سفيان، عن منصور، عن إبراهيم، قال: ذكر عنده قول ابن عباس، فقال:" هما سواء" .
It is narrated from Ibrahim, may Allah have mercy on him, that when the statement of Ibn Abbas, may Allah be pleased with them both, was mentioned, he said: "Both are equal."

Hadith Number: 1644
نا حماد بن زيد ، عن شعيب بن الحبحاب ، عن إبراهيم ، قال: ذكر عند عائشة رضي الله عنها الخيار , فقالت:" قد خيرنا رسول الله صلى الله عليه وسلم , فاخترناه فلم يعد ذلك طلاقا" .
Lady Aisha (may Allah be pleased with her) said: "The Messenger of Allah (peace and blessings be upon him) gave us the option, so we chose him, and we did not consider that as a divorce."

نا ابو عوانة ، عن سليمان ، عن ابي الضحى ، عن مسروق ، عن عائشة رضي الله عنها , قالت: " خيرنا رسول الله صلى الله عليه وسلم , فاخترناه فلم يعدها طلاقا" .
Lady Aisha (may Allah be pleased with her) said: "The Messenger of Allah (peace and blessings be upon him) gave us the choice, and we chose him, and the Prophet (peace and blessings be upon him) did not count that as a divorce."

نا ابو معاوية ، قال: نا الاعمش ، عن مسلم ، عن مسروق , ان عائشة رضي الله عنها , قالت: " خيرنا رسول الله صلى الله عليه وسلم , فاخترناه فلم يعدها علينا شيئا" .
Lady Aisha (may Allah be pleased with her) said: "The Messenger of Allah (peace and blessings be upon him) gave us the choice, so we chose him, and he (peace be upon him) did not consider that as anything against us."

نا هشيم ، قال: انا مغيرة ، عن إبراهيم ، عن عائشة رضي الله عنها , قالت: " خيرنا رسول الله صلى الله عليه وسلم , فاخترناه فلم يكن طلاقا" .
Lady Aisha (may Allah be pleased with her) said: "The Messenger of Allah (peace and blessings be upon him) gave us the choice, so we chose him, and this was not a divorce."

Hadith Number: 1648
نا نا ابو عوانة، عن بيان، عن عامر، قال: سالني عبد الحميد عن الخيار، فقلت: كان عبد الله بن مسعود يقول: " إن اختارت نفسها واحدة، وإن اختارت زوجها فلا شيء" . قال علي رضي الله عنه: " إن اختارت زوجها فواحدة، وهو احق بها، وإن اختارت نفسها فواحدة بائنة" . وقال زيد بن ثابت : " إن اختارت نفسها فثلاث" , فقال: اقض فيها بقول عبد الله.
Hazrat Amir Sha'bi (may Allah have mercy on him) said: Abdul Hameed asked me about the matter of choice (khiyar). I said: "Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) used to say: If a woman chooses herself, then one irrevocable divorce (talaq bain) will take place, and if she chooses her husband, then nothing happens." Sayyiduna Ali (may Allah be pleased with him) said: "If the woman chooses her husband, then one divorce and the husband has more right, and if she chooses herself, then one irrevocable divorce." And Sayyiduna Zaid bin Thabit (may Allah be pleased with him) said: "If she chooses herself, then three divorces." So it was said: "Decide in this matter according to the statement of Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him)."

Hadith Number: 1649
نا نا هشيم، قال: انا مغيرة، عن إبراهيم، ان عمر ، وابن مسعود , قالا في الرجل إذا خير امراته فاختارت نفسها" فهي واحدة وهو احق بها، وإن اختارت زوجها فلا شيء" .
It is narrated from Ibrahim (may Allah have mercy on him) that Sayyiduna Umar (may Allah be pleased with him) and Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) used to say: "If a woman chooses herself, then there is one divorce and the husband has more right, and if she chooses the husband, then nothing (happens)."

نا نا هشيم، قال: انا مغيرة، عن إبراهيم، وانا إسماعيل بن ابي خالد، عن الشعبي، ان عليا رضي الله عنه , كان يقول: " إن اختارت نفسها فواحدة بائنة، وإن اختارت زوجها فواحدة , وهو احق بها" .
Sayyiduna Ali (may Allah be pleased with him) said: "If the woman chooses herself, then it is one irrevocable divorce; and if she chooses her husband, then it is one divorce and the husband has more right."

نا نا هشيم، قال: انا مغيرة، عن إبراهيم، عن زيد بن ثابت ، انه كان يقول: " إن اختارت نفسها فثلاث، وإن اختارت زوجها فواحدة" .
Sayyiduna Zaid bin Thabit (may Allah be pleased with him) said: "If a woman chooses herself, then three divorces; and if she chooses her husband, then one divorce."

نا هشيم، انا إسماعيل بن ابي خالد، عن الشعبي، عن زيد بن ثابت ، مثل ذلك.
There is a similar narration from Sayyiduna Zaid bin Thabit (may Allah be pleased with him).
