Book of Divorce
بَابُ الرَّجُلِ يَجْعَلُ أَمْرَ امْرَأَتِهِ بِيَدِهَا
Chapter on a man giving his wife the right to decide
Hadith Number: 1633
نا خالد بن عبد الله، عن بيان، عن عامر الشعبي، ومغيرة، عن إبراهيم، وعامر، قالا في رجل قال لامراته: اختاري، اختاري، اختاري، فاختارت مرة واحدة , قالا:" وهي ثلاث , وإن قال لها: اختاري فاختارت ثلاثا , فهي واحدة" .
Hazrat 'Amir Sha'bi (may Allah have mercy on him) and Ibrahim (may Allah have mercy on him) said: "When a man says to his wife three times: 'Choose, choose, choose,' and the wife chooses once, then three divorces will take place; and if he says it once and the wife gives divorce three times, then only one divorce will take place."

Hadith Number: 1634
نا هشيم، قال: انا مغيرة، عن إبراهيم، قال: " إذا جعل الرجل امر امراته بيد غيرها فطلقها ثلاثا، فهي واحدة، وهو احق بها" .
Ibrahim (may Allah have mercy on him) said: "When a man entrusts the matter of his wife to someone else and he gives her three divorces, then this will count as one divorce and the husband will have more right to take her back."

Hadith Number: 1635
نا هشيم، قال: انا منصور، ويونس، عن الحسن، انه كان يقول: " إذا جعل الرجل امر امراته بيد غيرها فالقضاء ما قضى، فإن ردها فواحدة، وهو احق بها" .
Hasan (may Allah have mercy on him) said: "When a man entrusts the matter of his wife to someone else, then the decision will be as that person makes. If he returns the wife, then it will be counted as one divorce and the husband will have more right (to take her back)."

Hadith Number: 1636
نا نا ابو معاوية، عن الحجاج، عن ابن ابي نجيح، عن مجاهد، قال: قال ابن مسعود : " إذا جعل الرجل امر امراته بيد رجل فقام الرجل قبل ان يقضي في ذلك شيئا، فلا امر له" .
Sayyiduna Ibn Mas'ud (may Allah be pleased with him) said: "When a man entrusts the matter of his wife to another man, and that man stands up before making a decision, then he no longer has any authority."

Hadith Number: 1637
نا هشيم، قال: انا منصور، عن الحسن، في رجل جعل امر امراته بيد رجلين فطلق احدهما , قال:" لا، حتى يجتمعا جميعا".
Hasan (may Allah have mercy on him) said: "When a man entrusts the matter of his wife to two men, and one of them pronounces divorce, it will not take effect until both of them decide together."

نا هشيم، قال: انا عبيدة، عن إبراهيم، مثل ذلك.
Ibrahim (may Allah have mercy on him) also said the same.

Hadith Number: 1639
نا نا هشيم، قال: انا مغيرة، عن إبراهيم، ان امراة، قالت لزوجها: لو ان الذي بيدك من امري بيدي لفارقتك , قال لها: فامرك بيدك , قالت: انت طالق ثلاثا، فرفع ذلك إلى عمر بن الخطاب رضي الله عنه فغضب من ذلك، وقال:" تعمدون إلى امر جعله الله بايديكم فتجعلونه بايديهن"، ثم قال:" واحدة وانت احق برجعتها" .
It is narrated that a woman said to her husband: "If the matter were in my hands, I would separate from you." The husband said: "The matter is in your hands." The woman said: "You are thrice divorced." This matter reached Sayyiduna Umar bin Khattab, may Allah be pleased with him. He became angry and said: "You people hand over the authority given by Allah into the hands of women." Then he said: "It is one divorce, and the husband has the right to take her back."

Hadith Number: 1640
نا نا عبد العزيز بن عبد الصمد العمي، قال: نا منصور، عن إبراهيم، عن الاسود، ان امراة، قالت لزوجها: لو ان الذي بيدك بيدي لعلمت ما اصنع , قال: فإن ما بيدي من امرك بيدك , فقالت: قد طلقتك، فاتوا ابن مسعود فسالوه، فقال عبد الله:" فعل الله بالرجال عمدوا إلى شيء جعله في ايديهم فولوه غيرهم، فهي واحدة , وساسال امير المؤمنين فساله، فقال عمر رضي الله عنه: في فيها التراب، ثلاث مرات، ثم قال لابن مسعود: ما قلت فيها؟ ," قال: قلت: واحدة , قال: ذاك رايك؟ , قال: نعم. قال: كذلك رايي، ولو رايت غير ذلك لم تصب" .
A similar incident came to our master Ibn Mas'ud (may Allah be pleased with him). He said: "Alas for the men, that Allah had given them authority in their hands, but they gave it to others. This is one divorce." Our master Umar bin Khattab (may Allah be pleased with him) also gave the same opinion.

Hadith Number: 1641
نا نا حماد بن زيد، عن عمرو بن دينار، قال: قال ابن عباس : " خطا الله نوءها" .
Ibn Abbas (may Allah be pleased with them both) said: "May Allah forgive the intention of a woman."

Hadith Number: 1642
نا نا سفيان، عن عمرو بن دينار، عن عطاء، عن ابن عباس ، انه سئل عن رجل جعل امر امراته بيدها , فقالت: انت الطلاق , انت الطلاق، فقال ابن عباس:" خطا الله نوءها" .
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them): When a woman, having obtained the authority from her husband, said: "You are divorced, you are divorced," he said: "May Allah cause her intention to err."
