Book of Divorce
بَابُ الرَّجُلِ يَجْعَلُ أَمْرَ امْرَأَتِهِ بِيَدِهَا
Chapter on a man giving his wife the right to decide
Hadith Number: 1653
نا نا هشيم، انا منصور، عن الحسن، عن زيد بن ثابت ، انه قال: " إن اختارت نفسها فثلاث، وإن اختارت زوجها فواحدة وهو احق بها" .
Sayyiduna Zaid bin Thabit (may Allah be pleased with him) said: "If a woman is given the choice regarding herself, then it is three divorces, and if she gives the choice to her husband, then it is one divorce and the husband has more right."

Hadith Number: 1654
نا هشيم، قال: انا مغيرة، عن إبراهيم، انه كان يقول: " امرك بيدك، واختاري هما سواء، إن اختارت نفسها فواحدة , وهو احق بها، وإن اختارت زوجها فلا شيء" .
Ibrahim (may Allah have mercy on him) said: " «امرك بيدك» (Your matter is in your own hand)" and " «اختاري» (Choose)" are both the same; if the woman chooses herself, then it is one divorce and the husband has more right, and if she chooses the husband, then nothing happens.

نا هشيم، قال: انا داود بن ابي هند، عن الشعبي، عن مسروق، انه كان يقول ذلك ايضا.
A similar narration is also reported from Hazrat Masruq (may Allah have mercy on him).

Hadith Number: 1656
نا نا هشيم، قال: انا ابن ابي ليلى، عن الحكم، ان عليا رضي الله عنه , كان يقول: " إذا جعل الامر بيدها، فهو بيدها، فما قضت فهو جائز" .
Sayyiduna Ali (may Allah be pleased with him) said: "When a man gives the matter into the woman's hand, then it is in her hand, and whatever decision she makes is permissible."

Hadith Number: 1657
نا هشيم، قال: انا يونس، ومنصور، عن الحسن، انه كان يقول: " إذا جعل الرجل امر امراته بيدها , فقد بانت بثلاث" .
Hasan (may Allah have mercy on him) said: "When a man gives his wife the matter (of divorce) into her own hands, then she is separated (divorced) with three divorces."

Hadith Number: 1658
نا ابو شهاب، عن الحجاج بن ارطاة، عن ابي جعفر، انه سئل عن المخيرة، قال: " إن اختارت زوجها فلا شيء" .
It is narrated from Hazrat Abu Ja'far (may Allah have mercy on him) that he was asked about the mukhayyara (a woman who is given the right of choice), so he said: "If the woman chooses her husband, then there is nothing (i.e., no effect)."

Hadith Number: 1659
نا نا هشيم، قال: انا يونس، عن الحسن، ان رجلا خرج من عند اهله، وهو لا ينكر منهم شيئا، فوجد امراته , فقالت:" لو ان الذي بيدك من امري بيدي لعلمت كيف اصنع، فقال الرجل: فنعم، فنعم، فارتفعوا إلى ابي موسى الاشعري فاخبروه بقصتهم، فقال ابو موسى: ذاك بك، ذاك بك" .
Hasan (may Allah have mercy on him) said: A man went to his wife and found no fault, so his wife said: "If the matter were in my hands, I would know what to do." The man said: "Yes." Then they went to Sayyiduna Abu Musa al-Ash'ari (may Allah be pleased with him), and he said: "This matter has happened with you."

Hadith Number: 1660
نا نا ابو وكيع، عن الهزهاز بن ميزن، ان عدي بن فرس خير امراته ثلاثا كل ذلك تختاره، فرفع إلى علي رضي الله عنه ," ففرق بينهما" . قال سعيد: فرس جد وكيع.
It is narrated that 'Adi bin Firas gave his wife the option three times, and each time she chose the option. The matter was taken to Sayyiduna Ali (may Allah be pleased with him), so he separated the two.

Hadith Number: 1661
نا نا ابو معاوية، قال: نا الحجاج، عن ابي جعفر، ان ابن ابي عتيق جعل امر امراته بيدها، فطلقت نفسها طلاقا كثيرا، فسال زيد بن ثابت , فقال:" هي واحدة وهو احق بها" .
Sayyiduna Zaid bin Thabit (may Allah be pleased with him) said: "This is one divorce and the husband has more right to take her back."

Hadith Number: 1662
نا نا يحيى بن سعيد، عن القاسم بن محمد، عن عائشة رضي الله عنها , انها زوجت بنتا لعبد الرحمن بن ابي بكر يقال لها: قريبة , فزوجتها من المنذر بن الزبير , فقدم عبد الرحمن من غيبته، فوجد من ذلك , وقال:" امثلي يفتات عليه في بناته؟" فقالت عائشة: اعن المنذر بن الزبير ترغب؟ لنجعلن امرها بيده، فجعل المنذر امر بنت عبد الرحمن بيده , فلم يقل عبد الرحمن في ذلك شيئا، ولم يروا ذلك شيئا" .
Lady Aisha (may Allah be pleased with her) said: I arranged the marriage of Qareebah bint Abdur Rahman bin Abi Bakr to Mundhir bin Zubair. When Abdur Rahman returned, he was displeased. Lady Aisha (may Allah be pleased with her) said: Are you upset with Mundhir? We will leave the matter to him. Then the matter was handed over to Mundhir.
