Muwatta Imam Malik Riwayat Yahya
بَابُ فِدْيَةِ مَنْ أَصَابَ شَيْئًا مِنَ الْجَرَادِ وَهُوَ مُحْرِمٌ
Compensation for One Who Kills Locusts While in Ihram
Hadith Number: 938
حدثني حدثني يحيى، عن مالك، عن زيد بن اسلم ، ان رجلا جاء إلى عمر بن الخطاب، فقال: يا امير المؤمنين، إني اصبت جرادات بسوطي، وانا محرم، فقال له عمر : " اطعم قبضة من طعام"
It is narrated from Hazrat Zaid bin Aslam that a man came to Sayyiduna Umar, may Allah be pleased with him, and said: O Commander of the Faithful! I killed a few locusts with a whip while I was in the state of Ihram. Sayyiduna Umar, may Allah be pleased with him, said: Give a handful of food to someone.

Hadith Number: 939
وحدثني، عن وحدثني، عن مالك، عن يحيى بن سعيد ، ان رجلا جاء إلى عمر بن الخطاب، فساله عن جرادات قتلها وهو محرم، فقال عمر، لكعب: تعال حتى نحكم، فقال كعب: درهم، فقال عمر :" إنك لتجد الدراهم لتمرة خير من جرادة"
It is narrated from Yahya ibn Sa'id that a man came to Sayyiduna Umar ibn Khattab (may Allah be pleased with him) and asked: I have killed a locust while in the state of ihram. Sayyiduna Umar (may Allah be pleased with him) said to Sayyiduna Ka'b (may Allah be pleased with him): Come, let us decide together. Sayyiduna Ka'b (may Allah be pleased with him) said: One dirham is obligatory. Sayyiduna Umar (may Allah be pleased with him) said: You have many dirhams; in my view, one date is better than a locust.

Compensation for One Who Shaves Before Slaughtering
Hadith Number: 940
حدثني يحيى، عن مالك، عن عبد الكريم بن مالك الجزري ، عن عبد الرحمن بن ابي ليلى ، عن كعب بن عجرة ، انه كان مع رسول الله صلى الله عليه وسلم محرما، فآذاه القمل في راسه، فامره رسول الله صلى الله عليه وسلم ان يحلق راسه، وقال: " صم ثلاثة ايام او اطعم ستة مساكين مدين مدين لكل إنسان، او انسك بشاة اي ذلك فعلت اجزا عنك"
It is narrated from Sayyiduna Ka'b bin 'Ujrah, may Allah be pleased with him, that he was with the Messenger of Allah, peace and blessings be upon him, in the state of Ihram, and lice infested his head. So the Messenger of Allah, peace and blessings be upon him, ordered him to shave his head and said: Fast for three days, or feed six needy people two mudd of food each, or slaughter a sheep. Whichever of these he does will suffice.

Hadith Number: 941
حدثني، عن مالك، عن حميد بن قيس ، عن مجاهد ابي الحجاج ، عن ابن ابي ليلى ، عن كعب بن عجرة ، ان رسول الله صلى الله عليه وسلم قال له:" لعلك آذاك هوامك" فقلت: نعم، يا رسول الله، فقال رسول الله صلى الله عليه وسلم: " احلق راسك، وصم ثلاثة ايام او اطعم ستة مساكين، او انسك بشاة"
It is narrated from Sayyiduna Ka'b bin Ujrah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Perhaps lice are troubling you?" He replied: "Yes, O Messenger of Allah!" The Prophet (peace and blessings be upon him) said: "Shave your head, and fast for three days, or feed six needy people, or sacrifice a goat."

Hadith Number: 942
وحدثني، عن مالك، عن عطاء بن عبد الله الخراساني ، انه قال: حدثني شيخ بسوق البرم، بالكوفة، عن كعب بن عجرة ، انه قال: جاءني رسول الله صلى الله عليه وسلم وانا انفخ تحت قدر لاصحابي، وقد امتلا راسي، ولحيتي قملا، فاخذ بجبهتي، ثم قال: " احلق هذا الشعر، وصم ثلاثة ايام، او اطعم ستة مساكين" وقد كان رسول الله صلى الله عليه وسلم علم انه ليس عندي ما انسك به .
It is narrated from Sayyiduna Ka'b bin Ujrah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) came to me while I was blowing on a pot for my companions, and my head and beard were filled with lice. The Prophet (peace and blessings be upon him) held my forehead and said: "Shave these hairs and observe three fasts, or feed six needy people." And the Messenger of Allah (peace and blessings be upon him) knew that I did not have anything for sacrifice.

Hadith Number: 942B1
قال مالك في فدية الاذى: إن الامر فيه ان احدا لا يفتدي حتى يفعل ما يوجب عليه الفدية، وإن الكفارة إنما تكون بعد وجوبها على صاحبها، وانه يضع فديته حيث ما شاء، النسك، او الصيام، او الصدقة بمكة، او بغيرها من البلاد.
Imam Malik, may Allah have mercy on him, said: No person should give the compensation for «أذي» unless he commits a fault, because committing a fault makes expiation obligatory, and he has the choice to give the compensation by sacrifice, or by fasting, or by charity, whether in Mecca or in any other city.

Hadith Number: 942B2
قال مالك: لا يصلح للمحرم ان ينتف من شعره شيئا، ولا يحلقه، ولا يقصره حتى يحل إلا ان يصيبه اذى في راسه، فعليه فدية، كما امره الله تعالى، ولا يصلح له ان يقلم اظفاره، ولا يقتل قملة، ولا يطرحها من راسه إلى الارض، ولا من جلده، ولا من ثوبه فإن طرحها المحرم من جلده، او من ثوبه، فليطعم حفنة من طعام
Imam Malik, may Allah have mercy on him, said: It is not permissible for any Muhrim to pluck, shave, or shorten his hair until he has exited the state of Ihram, except in the case where there is harm to his head, then a fidya will be obligatory, as Allah, Glorified and Exalted is He, has commanded. And it is not permissible for a Muhrim to cut his nails, kill lice, remove lice from his head and throw them on the ground, or remove lice from his body or clothes. If he does so, he should give a handful of grain in charity for the sake of Allah.

Hadith Number: 942B3
قال مالك: من نتف شعرا من انفه، او من إبطه، او اطلى جسده بنورة، او يحلق عن شجة في راسه لضرورة، او يحلق قفاه لموضع المحاجم وهو محرم ناسيا، او جاهلا إن من فعل شيئا من ذلك، فعليه الفدية في ذلك كله، ولا ينبغي له ان يحلق موضع المحاجم.
Imam Malik, may Allah have mercy on him, said: Whoever plucks the hair of his nose, or his armpits, or applies depilatory to his body, or has a wound on his head and shaves his head out of necessity, or shaves the hair of his nape for cupping while in the state of ihram, if he does any of these things out of forgetfulness or ignorance, then in all these cases, he must offer a fidya (compensation). And it is not permissible for a person in ihram to shave the place for cupping.

قال مالك: ومن جهل فحلق راسه قبل ان يرمي الجمرة افتدى
Imam Malik, may Allah have mercy on him, said: Whoever shaves his head before throwing the pebbles out of ignorance must offer a fidya (compensation).

بَابُ مَا يَفْعَلُ مَنْ نَسِيَ مِنْ نُسُكِهِ شَيْئًا
What to Do if One Forgets Part of His Rituals
Hadith Number: 943
حدثني حدثني يحيى، عن مالك، عن ايوب بن ابي تميمة السختياني ، عن سعيد بن جبير ، عن عبد الله بن عباس ، قال: " من نسي من نسكه شيئا او تركه فليهرق دما" . قال ايوب: لا ادري، قال: ترك او نسي.
It is narrated from Sa'id bin Jubair that Sayyiduna Ibn Abbas (may Allah be pleased with them) said: Whoever forgets or leaves out any of his acts (of Hajj), he should offer a sacrifice (i.e., an animal). Ayyub said: I do not remember whether Sa'id said "forgets" or "leaves out."
