If Three People Testify to a Man Divorcing His Wife in Different Places, What Is the Ruling?

٢٠٢٠٤ - حدثنا ابو بكر قال: نا إسماعيل بن (عياش) (١) عن عطاء الخراساني ان رجلا طلق امراته فشهد عليه ثلاثة نفر، كل رجل يشهد في موطن غير موطن صاحبه (فقضى) (٢) عبد الله بن موهب انها تطليقة.

Hazrat Ata Khurasani (may Allah have mercy on him) says that a man divorced his wife and made three men witnesses to it. Each person testified that he gave the divorce at a different place. In this situation, Hazrat Abdullah bin Muhab gave the verdict that this would be counted as one divorce.

If a Man Says to His Wife, 'If You Enter So-and-So's House, You Are Divorced,' and She Enters Partially, What Is the Ruling?

٢٠٢٠٥ - حدثا ابو بكر قال: نا جرير عن مغيرة عن حماد قال: إذا قال الرجل لامراته: انتما طالق إن دخلت بيت فلان، فادخلت (بعض) (١) جسدها فقد وقع الطلاق عليها.

Hazrat Hammad (may Allah have mercy on him) says that if a man says to his wife, "If you enter the house of such-and-such person, you are divorced," and she enters even a part of her body into that house, then she will be divorced.

If a Man Says to His Wife, 'You Are Not Lawful for Me,' What Is the Ruling?

٢٠٢٠٦ - حدثنا ابو بكر قال: نا شريك عن جابر عن عامر في رجل قال ⦗٤٤٩⦘ لامراته: لا تحلين لي؟ قال: نيته، إن نوى واحدة فواحدة، وإن نوى ثلاثا فثلاث.
Hazrat Aamir, may Allah have mercy on him, says that if a man says to his wife, "You are not lawful for me," then his intention will be considered; if he intended one (divorce), then one, and if he intended three, then three divorces will take place.

٢٠٢٠٨ - حدثنا ابو بكر قال: نا مروان بن معاوية عن واقد مولى بني حنظلة قال: سئل عطاء بن (ابي) (١) رباح عن رجل اخذ (لصا) (٢) فاجتمع عليه الناس فطلبوا إليه ان يتركه، فقال: إن تركته (فامراته) (٣) طالق ثلاثا، فغلبه على نفسه (فانفلت) (٤) منه قال: فقال عطاء: ليس عليه شيء (٥) إنما (غلبه) (٦) على نفسه.

Hazrat Ata bin Abi Rabah (may Allah have mercy on him) was asked that if a person caught a thief, then people gathered around him and demanded that he release the thief. He said that if he released him, his wife would have three divorces. Then the thief overpowered him and escaped from him, so Hazrat Ata said that nothing is incumbent upon him; the thief had overpowered him.

Can a Man Marry Off His Minor Daughter?

٢٠٢٠٩ - حدثنا ابو بكر قال: نا هشيم عن يونس عن الحسن انه كان يقول: إذا زوج الرجل ابنته وهي صغيرة فراى ان يخلعها، فذلك جائز عليها.
Hazrat Hasan (may Allah be pleased with him) used to say that if a person marries off his minor daughter without her consent and then she wishes to obtain khula without her consent (separation), it is permissible for her to seek khula. However, Hazrat Hasan (may Allah be pleased with him) also used to say that obtaining khula is not permissible without a valid reason.

٢٠٢١١ - حدثنا ابو بكر قال: نا شريك عن جابر عن عامر عن شريح ان رجلا خلع ابنته فلم ترض قال: وقع عليها الطلاق، وابوها ضامن لما افتدى به.
Hazrat Shurayh (may Allah have mercy on him) says that if a person wants to arrange khula on behalf of his minor daughter but she does not consent, then divorce will take place and her father will be responsible for the compensation.

٢٠٢١٢ - حدثنا ابو بكر قال: نا يحيى بن آدم قال: نا زهير عن جابر عن عامر (و) (١) الحكم في امراة قال لها زوجها: إذا حضت فانت طالق، فارتفعت حيضتها و (حبلت) (٢) (قالا) (٣): (٤) (يجامعها) (٥) حتى تحيض.

Hazrat Amir (may Allah have mercy on him) and Hazrat Hakam (may Allah have mercy on him) say that if a man says to his wife, "When you menstruate, you are divorced," then her menstruation stops and she becomes pregnant, the man can have intercourse with her until she menstruates. Hazrat Amir (may Allah have mercy on him) says that if this is valid in the near term, it is also valid in the distant term.
