٢٠٢١٤ - حدثنا ابو بكر قال: نا (وكيع قال: نا) (١) شعبة قال: سالت الحكم وحمادا عن رجل قال لامراته: انت طالق كلما شئت، قال الحكم: كلما شاءت فهي طالق.

Hazrat Sha’bah (may Allah have mercy on him) says that I asked Hazrat Hakam (may Allah have mercy on him) and Hazrat Hammad (may Allah have mercy on him) that if a man says to his wife,“You are divorced whenever you wish,”then what is the ruling? Hazrat Hakam said that she will be divorced whenever she wishes, and Hazrat Hammad said that divorce can occur only once.

Who Holds the Right of Divorce?

٢٠٢١٦ - حدثنا ابو بكر قال: نا (عفان) (١) قال: نا ابو عوانة عن (ابي) (٢) بشر عن عطاء قال: إذا زوج الاب فالطلاق بيد الاب.

(٢) في [ب]: (أبي بن)، وفي [س، ط، هـ]: (ابن أبي).
Hazrat Ata (may Allah have mercy on him) says that when the father arranges the marriage, then the right of divorce will also belong to him. Hazrat Mujahid says that whoever has authority over the marriage will also have authority over the divorce.

٢٠٢٢٢ - حدثنا ابو بكر قال: نا حفص عن ابن (جريج) (١) قال: قلت لعطاء ابلغك ان رسول الله ﷺ ترك اهل الجاهلية على ما كانوا عليه من نكاح او طلاق؟ قال: نعم (٢).

Hazrat Ibn Jurayj (may Allah have mercy on him) says that I asked Hazrat Ata whether this has reached you regarding the Messenger of Allah (peace and blessings be upon him) that he maintained for the people of ignorance the rules of marriage and divorce that were prevalent among them? He replied, yes, it is so.

Hazrat Sha’bah, may Allah have mercy on him, says that I asked Hazrat Hakam and Hazrat Hammad about the divorce given in the state of polytheism, so they said that it is valid.
