One Who Makes a Bequest for Someone Who Dies Before Him

٣٢٧٧٨ - حدثنا جرير عن مغيرة عن حماد في الرجل يوصي بالوصية فيموت الموصى له قبل الذي اوصى قال: تبطل، (وإن) (١) مات الذي اوصى ثم الذي اوصي له، كان لورثته.
ريفرينس و تحكيم الحدیث:
(١) في [م]: (فإن).
Hammad says regarding the person who made a bequest, and the one for whom the bequest was made dies before him, that the bequest becomes void. And if the one who made the bequest dies first, then the one for whom the bequest was made, then his heirs will be entitled to that wealth.

One Who Bequeaths a Third and Then Acquires More Wealth Before Death

٣٢٧٧٩ - (١) حدثنا هشيم عن مغيرة (٢) عن إبراهيم في رجل اوصى لرجل بثلث ماله، وافاد مالا قبل ان يموت ثم مات، قال: له الثلث الذي اوصى له، وله ثلث ما افاد.

It is narrated from Ibrahim regarding the man who makes a will for one third of his wealth for someone, and then before dying his wealth increases, and then he dies: He said, the person for whom the will was made is entitled to one third of the original wealth and also one third of the newly acquired wealth.

٣٢٧٨٠ - (١) حدثنا حفص عن سعيد عن قتادة عن خلاس عن علي في رجل اوصى بثلث ماله وقتل خطا، قال: الثلث داخل في ديته (٢).

(٢) ضعيف؛ سعيد اختلط.
Khallas narrates from Hazrat Ali (may Allah be pleased with him) that regarding the man who made a will for one third of his wealth and was then killed by mistake, he said: The bequest of one third will also be taken from his blood money.

٣٢٧٨١ - حدثنا حفص عن اشعث عن ابي إسحاق عن الحارث عن علي قال: له ثلث ماله، (وثلث ديته) (١) (٢).

(٢) ضعيف؛ لضعف الحارث والأشعث.
Harith narrates the statement of Hazrat Ali (may Allah be pleased with him) that the person will be given one-third of the bequeather’s property and also one-third of his blood money.

٣٢٧٨٢ - حدثنا محمد بن ابي عدي عن اشعث عن الحسن في الرجل (إذا) (١) ⦗١٧٩⦘ اوصى بثلث ماله (فقتل) (٢) خطا، قال: يدخل ثلث الدية في ثلث ماله.

It is narrated from Hasan (may Allah have mercy on him) regarding the man who made a will for one third of his wealth and was then killed by mistake, he said: One third of the blood money will be included in one third of his wealth.

٣٢٧٨٣ - حدثنا عباد عن اشعث عن الشعبي قال: اهل الوصية شركاء في الوصية، إن زادت وإن نقصت.
Ash'ath narrates from Hazrat Sha'bi, who said: The heirs of the will shall share in the property of the will, whether it increases or decreases. Ash'ath says that when I related this to Muhammad bin Sirin, he approved of it.

٣٢٧٨٥ - حدثنا زيد بن الحباب عن ابن لهيعة عن يزيد بن ابي حبيب عن عمر ابن عبد العزيز في رجل اوصى لرجل بوصية ثم جاءه مال او افاد مالا، قال: لا يدخل (فيه) (١).

Yazid bin Abi Habib narrates from Hazrat Umar bin Abdul Aziz (may Allah have mercy on him) regarding the man who made a bequest for someone, then later acquired wealth; he said that the additional wealth will not be included in that bequest.

٣٢٧٨٦ - (١) حدثنا حفص عن الاعمش عن إبراهيم قال: إذا اوصى الرجل للرجل بخمسين درهما عجلت له من العين، وإذا اوصى بثلث او ربع كان في العين والدين.

It is narrated from A’mash that Ibrahim said: When a person makes a bequest of fifty dirhams for someone, those dirhams will be given to him from the deceased’s liquid assets. And when someone makes a bequest of one third or one fourth of the wealth, that amount will be given to that person from both the deceased’s liquid assets and debts.

Amr Hasan narrates regarding the man who makes a bequest of fifty dirhams from his wealth for someone; he (the Prophet) said that it should be given from one third of the present cash wealth.
