٣٣٧٤٠ - حدثنا يزيد بن هارون قال: اخبرنا هشام عن ابن سيرين ان ابا الهذيل اسلم على يديه رجل، فمات وترك عشرة آلاف (درهم) (١)، فاتى بها ابو (الهذيل) (٢) زيادا، فقال زياد: انت احق بها، فقال: لا حاجة لي فيها، فقال زياد: انت وارثه، فابى فاخذها زياد فجعلها في بيت المال.

Ibn Sirin narrates that a man accepted Islam at the hand of Abu al-Hudhayl and then died. He left behind ten thousand dirhams. Abu al-Hudhayl brought this to Ziyad. Ziyad said, "You are entitled to it." He replied, "I have no need for it." Ziyad said, "You are his heir," but he refused to accept it. So Ziyad took it and placed it in the public treasury (Bayt al-Mal).

٣٣٧٤١ - حدثنا وكيع قال: ثنا سفيان عن مطرف عن الشعبي.
Mutarrif narrates from Sha'bi, and Yunus narrates from Hasan, he said: His inheritance is for the Muslims, and his liability is upon them.

٣٣٧٤٣ - حدثنا وكيع قال: ثنا داود بن ابي عبد الله قال: كانت لنا ظئر ولها ابن اسلم على ايدينا فمات (١) وترك مالا، فسالت الشعبي فقال: ادفعه إلى امه.

Dawud bin Abi Abdullah narrates that we had a wet nurse whose son had accepted Islam at our hands. He died and left behind wealth. I asked Hazrat Sha'bi, and he said: "Give it to his mother."

٣٣٧٤٤ - حدثنا وكيع قال: ثنا حسن بن صالح عن مطرف عن الشعبي قال: لا ولاء إلا لذي نعمة.
Mutarrif narrates from Sha’bi that he said:“There is no wala’ except for the one who does a favor.”

٣٣٧٤٥ - حدثنا عبد الاعلى عن يونس عن الحسن في رجل والى رجلا فاسلم على يديه قال: لا يرثه إلا انه إن شاء اوصى له بماله كله.
Yunus reports from Hasan regarding the man who forms an alliance (muwalat) with another man, and that person accepts Islam at his hand. He said that he will not be his heir, except that if he wishes, he can make a bequest for him of the entire wealth.

Regarding a Man Who Dies with No Known Heir

٣٣٧٤٦ - حدثنا وكيع قال: ثنا سفيان عن عبد الرحمن بن الاصبهاني عن مجاهد بن وردان عن عروة بن الزبير عن عائشة ان مولى للنبي ﷺ وقع من نخلة فمات، وترك مالا ولم يدع ولدا ولا حميما، فقال النبي ﷺ:"اعطوا ميراثه رجلا من اهل قريته" (١).

Urwah bin Zubair narrates from Hazrat Aisha (may Allah be pleased with her) that a freed slave of the Noble Prophet (peace and blessings be upon him) fell from a tree and died, and he left behind wealth but no children or friends. The Noble Prophet (peace and blessings be upon him) said that his inheritance should be given to someone from among the people of his village.

٣٣٧٤٧ - حدثنا وكيع قال: ثنا علي بن مبارك عن يحيى بن ابي كثير عن محمد ابن عبد الرحمن بن ثوبان ان رجلا من جرهم توفي بالسراة وترك مالا، فكتب فيه إلى عمر، فكتب عمر إلى الشام فلم يجدوا بقي من جرهم واحد، فقسم عمر ميراثه في القوم الذين توفي فيهم (١).

(١) منقطع؛ محمد بن عبد الرحمن بن ثوبان لا يروي عن عمر.
Muhammad bin Abdur Rahman bin Thawban reports that a man from the tribe of Jurhum died at the place of Sarat and left behind wealth. This matter was written to Umar, so Umar (may Allah be pleased with him) wrote a letter towards Syria, but no man from the tribe of Jurhum was found. So Umar distributed his inheritance among the people among whom he had died.

٣٣٧٤٨ - حدثنا بشر بن المفضل عن عبد الرحمن بن إسحاق عن ابيه عن عبد الرحمن بن عمرو بن سهل قال: مات مولى على عهد عثمان ليس له مولى، فامر عثمان بماله فادخل بيت المال (١).

Abdur Rahman bin Amr bin Sahl narrates that during the time of Hazrat Uthman, there was a person from Marajis who had no freed slave; he (Hazrat Uthman) included his inheritance in the Bayt al-Mal.

٣٣٧٤٩ - حدثنا وكيع عن إسماعيل عن الشعبي عن مسروق سئل عن رجل مات ولم يترك مولى عتاقة ولا وارثا قال: ماله حيث وضعه، فإن لم يكن اوصى بشيء فماله في بيت المال.
Sha'bi says that Masruq was asked about a man who had died and at the time of his death he had not left behind a "Mawla 'Utaqa" nor any heir. He replied that his wealth will go wherever he had designated it to go; if he had not made any bequest, then his wealth will go to the Bayt al-Mal (public treasury).
