٣٥٠٣١ - قال (ابو) (١) إسحاق: فقمت إلى (اسير) (٢) بن عمرو فقلت: الا ترى إلى ما حدثني به عمرو بن ابي قرة وحدثت به، فقال: صدق جاء به كتاب عمر.

35031 - Abu Ishaq said: So I went to Asir ibn Amr and said: Do you not see what Amr ibn Abi Qurrah has narrated to me and I have narrated it? He said: He spoke the truth; it came with the letter of Umar.

٣٥٠٣٢ - حدثنا معن بن عيسى عن ابن ابي ذئب عن الزهري قال: يوقف مال الاسير وامراته حتى يسلما او يموتا.
Hazrat Ibn Abi Dhi'b (may Allah have mercy on him) states that Imam Zuhri (may Allah have mercy on him) said: The wealth of the prisoner and his wife will be withheld until both are handed over or both die.

٣٥٠٣٣ - حدثنا محمد بن مصعب قال: حدثني الاوزاعي قال: سالت الزهري عن الاسير في ارض العدو متى (تزوج) (١) امراته فقال: لا تزوج ما علمت انه حي.
ريفرينس و تحكيم الحدیث:
(١) في [هـ]: (تزوج)، وفي [جـ]: (نروح).
Imam Awza'i (may Allah have mercy on him) says that I asked Hazrat Zuhri (may Allah have mercy on him) about a person who has been taken captive in enemy territory, that when can his wife remarry? He (may Allah be pleased with him) replied: She cannot remarry as long as it is known that he is alive.

Captives in Enemy Hands and Their Bequest Regarding Their Wealth

٣٥٠٣٤ - حدثنا عبد الاعلى عن هشام عن الحسن في الاسير في ايدي العدو إن اعطى عطية او نحل نحلا واوصى بثلثه فهو جائز.
Hazrat Hisham (may Allah have mercy on him) narrates that Hasan (may Allah have mercy on him) said regarding a prisoner in the custody of the enemy: If he gives a gift to someone or gives something to someone of his own will, and makes a bequest of one-third of his wealth, then it is permissible.

٣٥٠٣٥ - حدثنا معن بن عيسى عن ابن ابي ذئب عن الزهري قال: لا يجوز للاسير في ماله إلا الثلث.
Hazrat Ibn Abi Dhi'b (may Allah have mercy on him) states that Imam Sha'bi (may Allah have mercy on him) said: It is permissible for a prisoner to make a bequest of only one-third of his wealth.

٣٥٠٣٦ - حدثنا علي بن مسهر عن داود عن الشعبي عن شريح قال: احوج ما يكون إلى ميراثه وهو اسير.
Hazrat Sha'bi (may Allah have mercy on him) narrates that Hazrat Shurayh (may Allah have mercy on him) said: The one most in need of his inheritance is the prisoner.

٣٥٠٣٧ - حدثنا ابن مهدي عن همام عن قتادة عن الحسن في ميراث الاسير قال: إنه محتاج إلى ميراثه.
Hazrat Qatadah (may Allah have mercy on him) says that Hasan (may Allah have mercy on him) said regarding a prisoner becoming an heir: Indeed, he is in need of this inheritance.

Hazrat Ibn Abi Dhi'b (may Allah have mercy on him) says that Imam Zuhri (may Allah have mercy on him) stated: The prisoner will become an heir.

Hazrat Qatadah (may Allah have mercy on him) narrates that Hazrat Saeed bin Al-Musayyib (may Allah have mercy on him) said: The prisoner will become an heir.

Those Who Said: The Captive Does Not Inherit

٣٥٠٤٠ - حدثنا ابن مهدي عن سفيان عمن سمع إبراهيم يقول: لا يرث الاسير.
Hazrat Sufyan (may Allah have mercy on him) narrates from the person who heard Ibrahim (may Allah have mercy on him) saying that a prisoner will not become an heir.
