Sunan Saeed bin Mansur
بَابُ لَا يُوَرَّثُ الْحَمِيلُ إِلَّا بِبَيِّنَةٍ
Chapter on a fetus not inheriting except with proof
Hadith Number: 254
نا عيسى بن يونس، عن الاعمش، عن ابيه مهران" ان مسروقا ورثه من اخ له وكان حميلا" .
Masruq (may Allah have mercy on him) made his brother, who was in the womb, his heir.

Hadith Number: 255
نا هشيم، قال: انا منصور، عن الحسن، وابن سيرين " انهما كانا يورثان الحميل" .
Hasan al-Basri (may Allah have mercy on him) and Ibn Sirin (may Allah have mercy on him) both considered the unborn child as an heir.

Hadith Number: 256
نا هشيم، قال: انا مغيرة، عن إبراهيم، قال: " كل رحم موصولة معروفة تورث" .
Ibrahim (may Allah have mercy on him) said: "Every relationship that is recognized and established, inheritance will be given in it."

Hadith Number: 257
نا نا هشيم، قال: انا عبيدة، عن إبراهيم، قال: قال ابن مسعود : " إذا تعارف الرجلان في الإسلام وتواصلا ورث كل واحد منهما صاحبه" .
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: "When two persons recognize each other in Islam and have a relationship with each other, then both will inherit from one another."

Hadith Number: 258
نا هشيم، عن ابي بشر، عن سعيد بن جبير، قال: " كان الرجل يعاقد الرجل فيرث كل واحد منهما صاحبه" .
Saeed bin Jubair (may Allah have mercy on him) said: "In the time of ignorance, a man would make a pact with another, and both would become heirs to each other."

وَكَانَ أَبُو بَكْرٍ «عَاقَدَ رَجُلًا فَوَرِثَهُ»
Abu Bakr had made a contract with a man, so he inherited from him
Hadith Number: 259
وكان ابو بكر " عاقد رجلا فورثه" . نا هشيم، عن بعض اصحابه , عن الحسن، قال: " كان الرجل يعاقد الرجل في الجاهلية فيقول: ترثني وارثك فيكون له السدس مما ترك، ثم يقسم اهل الميراث مواريثهم فنسختها واولو الارحام بعضهم اولى ببعض سورة الانفال آية 75" .
Hasan al-Basri (may Allah have mercy on him) said: "In the time of ignorance, a man would make an agreement with another that 'I will be your heir and you will be mine,' so the one who made the agreement would receive one-sixth, then the rest of the heirs would divide the remaining wealth among themselves. Then Allah the Exalted abrogated this through 'But those of blood relationship are nearer to one another' [الأحزاب: 6] ."

Hadith Number: 260
نا سفيان، عن ابن ابي نجيح، عن مجاهد، في قوله تعالى: " ولكل جعلنا موالي سورة النساء آية 33 , قال: العصبة , والذين عقدت ايمانكم سورة النساء آية 33 , قال: الحلفاء , فآتوهم نصيبهم سورة النساء آية 33 , من العقل، والنصر، والرفادة" .
Mujahid (may Allah have mercy on him) said in the explanation of Allah Almighty’s statement ‘And for all We have made heirs’ [النساء: 33] :“What is meant are the ‘asabat (male relatives through the father).”And in the explanation of ‘And those with whom your right hands have made a covenant’:“What is meant are the allies.”And he gave the meaning of ‘So give them their share’ [النساء: 33] as:“Blood money, help, and maintenance.”

بَابُ الرَّجُلِ يُعْتِقُ فَيَمُوتُ وَيَتْرُكُ وَرَثَةً ثُمَّ يَمُوتُ الْمُعْتَقُ
Chapter on a man who frees a slave, then dies and leaves heirs, then the freed slave dies
Hadith Number: 261
نا هشيم، قال: انا مغيرة، قال: سالت إبراهيم عن رجل اعتق مملوكا ومات وترك اباه وابنه، ثم مات المعتق قال:" لابيه السدس، وما بقي فلابنه" .
Ibrahim (may Allah have mercy on him) was asked about a man who freed a slave and then died, leaving behind his father and his son. Then the freed slave died. He said: "The father will get one-sixth, and the rest will go to the son."

Hadith Number: 262
نا هشيم، قال: انا منصور، عن الحسن، انه كان يقول: " الميراث كله للابن" .
Hasan al-Basri (may Allah have mercy on him) said: "All the inheritance is for the son."

Hadith Number: 263
نا هشيم، قال: انا محمد بن سالم، عن الشعبي انه كان يقول ذلك.
Ash-Sha'bi (may Allah have mercy on him) also said: "All the inheritance is for the son."
