Sunan Saeed bin Mansur
بَابُ الْأَمَةِ تَكُونُ بَيْنَ الرَّجُلَيْنِ يُصِيبُهَا أَحَدُهُمَا
Chapter on a slave woman shared between two men, one of whom has intercourse with her
Hadith Number: 2035
نا هشيم، انا يونس، عن الحسن، ومغيرة، عن إبراهيم، انهما قالا: " لا حد عليه وتقوم عليه إن حبلت" .
Hasan al-Basri and Ibrahim al-Nakha'i, may Allah have mercy on them, said: "There is no hadd; if pregnancy occurs, then compensation will also be obligatory."

Hadith Number: 2036
نا هشيم، انا محمد بن سالم، عن الشعبي، قال: " إن حبلت قومت عليه، وإن لم تحبل كان عليه نصف عقرها، وكانت امته على حالها" .
Hazrat Sha'bi (may Allah have mercy on him) said: "If the slave-girl becomes pregnant, then the full price will be obligatory, otherwise half the price should be paid and the slave-girl will remain in her condition."

Hadith Number: 2037
نا يزيد بن هارون، عن الحجاج، عن ابي معبد ختن الحكم، ان شريحا" اختصم إليه في رجلين بينهما جارية فوطئها احدهما فضمنه نصف الثمن ونصف العقر" .
Qadi Shurayh (may Allah have mercy on him) gave a verdict between two men regarding a slave girl that the one who had intercourse with her is liable for half of her price and half of the compensation.

Chapter: A man has a sinful slave woman and then makes her chaste
Hadith Number: 2038
نا هشيم، انا ابو حرة، عن الحسن، انه كان يقول في الرجل يفجر بالامة، ثم يشتريها قال:" كان يكره ان يقربها" .
Hasan al-Basri (may Allah have mercy on him) said: "Whoever commits fornication with a slave woman and then buys her, it was considered disliked to have relations with her."

Hadith Number: 2039
نا هشيم، انبا منصور، عن معاوية بن قرة، ان مسعودا،" كان يكره للرجل ان يطا امته إذا فجرت، او يطاها وهي مشركة".
Hazrat Masood, may Allah have mercy on him, said: "If a man commits adultery with his slave-girl or has intercourse with a jointly-owned slave-girl, then this was considered disliked."

Hadith Number: 2040
نا نا سفيان، عن ايوب، عن الوليد ابي بشر، عن سعيد بن ابي الحسن، عن ابن عباس ، قال: دخلوا عليه اول النهار وهو صائم، ثم دخلوا عليه في آخره وهو مفطر، فسالوه فقال:" مرت بي جارية فاعجبتني، وازيدكم انها كانت بغيا فحصنتها" .
Ibn Abbas (may Allah be pleased with them both) said: "I was fasting during the day, but in the evening I became attracted to a slave woman who was immoral, so I married her and thus protected her."

Hadith Number: 2041
نا نا هشيم، انا حميد الطويل، عن الحسن بن مسلم، عن سعيد بن جبير، قال: دخلنا على ابن عباس في صدر النهار فوجدناه صائما ثم رحنا إليه بالعشي فوجدناه مفطرا، فقلنا له: الم تك صائما؟ قال:" بلى، ولكن جارية لي اتت علي فاعجبتني، فاصبت منها، وإنما هو تطوع وساقضي يوما مكانه، وازيدكم انها كانت بغيا فحصنتها، وإنه قد عزل عنها" . قال سعيد: فعلمنا اربعة اشياء في حديث واحد.
Hazrat Saeed bin Jubair (may Allah have mercy on him) said: "We went to Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) in the early part of the day and he was fasting. Then we went in the evening and he had broken his fast. We asked: Were you not fasting? He replied: Why not, but one of my slave girls came, I liked her, so I had intercourse with her, and it was a voluntary fast, which I will make up. And shall I tell you more? She was previously an immoral woman, so I married her and purified her, and at the time of intercourse I also practiced coitus interruptus (azl) with her." Sayyiduna Saeed bin Jubair (may Allah have mercy on him) said: "We learned four rulings from this one hadith."

Chapter on a man who has a non-Muslim slave woman—Is it permissible for him to have intercourse with her?
Hadith Number: 2042
نا ابو عوانة، عن موسى بن ابي عائشة، قال: سالت مرة الهمداني عن الرجل يطا امته وهي مجوسية، وسالت سعيد بن جبير فكان اشدهما قولا، وقال:" إن فعلوا فما هم بخير منهن" .
Musa bin Abu Aisha (may Allah have mercy on him) said: "I asked Murrah al-Hamdani about a man who has intercourse with his Magian slave woman, and I also asked Sayyiduna Sa'id bin Jubair (may Allah have mercy on him), and both of them were among those who gave a harsh response." Sayyiduna Sa'id bin Jubair (may Allah have mercy on him) said: "If they do such a thing, then they are no better than those slave women."

Hadith Number: 2043
نا جرير، عن موسى بن ابي عائشة، عن مرة الهمداني، وسعيد بن جبير، مثله.
This same statement is narrated from Hazrat Marrah Hamdani and Hazrat Saeed bin Jubair, may Allah have mercy on them, that if someone has intercourse with his Magian slave woman, then he is just like them; no virtue remains.

Hadith Number: 2044
نا جرير، عن مغيرة، عن حماد، عن إبراهيم، انه قال: " إذا سبيت اليهوديات والنصرانيات يجبرن على الإسلام، فإذا اسلمن وطئن واستخدمن، وإن ابين وطئن واستخدمن، وإذا سبيت المجوسيات وعبدة الاوثان اجبرن على الإسلام، فإن اسلمن وطئن واستخدمن، وإن لم يسلمن استخدمن ولم يوطان" .
Ibrahim (may Allah have mercy on him) said: "When Jewish and Christian women are taken captive, they should be required to accept Islam. If they accept Islam, then intercourse and service may be taken from them; if they refuse, then only service may be taken, but not intercourse. And when Magian and idol-worshipping women are taken captive, Islam should also be required of them; if they accept Islam, then both intercourse and service may be taken from them, and if they do not accept Islam, then only service may be taken, not intercourse."
