Hadith Number: 5097
اخبرنا ابو خليفة ، قال: حدثنا القعنبي قال، حدثنا ليث بن سعد ، عن ابن شهاب ، عن محمد بن النعمان ، وحميد بن عبد الرحمن، عن النعمان بن بشير ، ان بشير بن سعد جاء إلى رسول الله صلى الله عليه وسلم، فقال: إني نحلت ابني هذا هذا العبد، فقال النبي صلى الله عليه وسلم: " اوكل ولدك نحلت هذا؟" قال: لا، قال:" فاردده" .
Sayyiduna Nu'man bin Bashir (may Allah be pleased with him) narrates: Sayyiduna Bashir bin Sa'd (may Allah be pleased with him) came to the service of the Prophet Muhammad (peace and blessings be upon him). He said: I have given this son of mine this slave as a gift. The Prophet Muhammad (peace and blessings be upon him) asked: Have you given all your children a gift like this? He replied: No. The Prophet Muhammad (peace and blessings be upon him) said: Then take it back.

ذكر الأمر بالتسوية بين الأولاد في النحل إذ تركه حيف-
Command to treat children equally in gifts, as favoritism is injustice
Hadith Number: 5098
اخبرنا الحسن بن محمد بن اسيد بفم الصلح، قال: حدثنا يحيى بن الفضل الخرقي ، قال: حدثنا حجاج بن نصير ، قال: حدثنا فطر بن خليفة ، عن ابي الضحى ، قال: سمعت النعمان بن بشير ، يقول: انطلق بي ابي إلى رسول الله صلى الله عليه وسلم ليشهده على عطية يعطينيها، فقال: " هل لك، ولد غيره؟" قال: قلت: نعم، قال:" سو بينهم" .
Sayyiduna Nu’man bin Bashir (may Allah be pleased with him) narrates: My father took me along to the service of the Prophet (peace and blessings of Allah be upon him) so that he could make the Prophet (peace and blessings of Allah be upon him) a witness to the gift he had given me. The Prophet (peace and blessings of Allah be upon him) asked: Do you have any other children besides him? He replied: Yes. The Prophet (peace and blessings of Allah be upon him) said: Then treat them equally (in giving gifts).

اخبرنا الحسن بن سفيان ، قال: حدثنا حبان بن موسى ، قال: اخبرنا عبد الله ، عن فطر ، عن مسلم بن صبيح ، قال: سمعت النعمان بن بشير وهو يخطب، يقول: انطلق بي ابي إلى النبي صلى الله عليه وسلم ليشهده على عطية اعطانيها، فقال: " هل لك بنون سواه؟" قال: نعم، قال:" سو بينهم" .
Sayyiduna Nu’man bin Bashir (may Allah be pleased with him) stated while delivering a sermon: My father took me along to the service of the Prophet Muhammad (peace and blessings be upon him) so that he could make the Prophet (peace and blessings be upon him) a witness to the gift he had given me. The Prophet (peace and blessings be upon him) asked: Do you have any other sons besides him? He replied: Yes. The Prophet (peace and blessings be upon him) said: Then treat them equally.

Hadith Number: 5100
اخبرنا عمر بن سعيد بن سنان ، قال: حدثنا احمد بن ابي بكر ، عن مالك ، عن ابن شهاب ، عن حميد بن عبد الرحمن ، ومحمد بن النعمان بن بشير ، عن النعمان بن بشير ، ان اباه اتى به رسول الله صلى الله عليه وسلم، فقال: إني نحلت ابني هذا غلاما كان لي، فقال رسول الله صلى الله عليه وسلم: " اكل ولدك نحلته مثل هذا؟" فقال: لا، فقال رسول الله صلى الله عليه وسلم:" فارجعه" .
Sayyiduna Nu’man bin Bashir (may Allah be pleased with him) narrates: His father took him along to the service of the Prophet Muhammad (peace be upon him). He submitted: I have given this son of mine a slave as a gift. The Prophet Muhammad (peace be upon him) asked: Have you given all your children a gift in this manner? He replied: No. The Prophet Muhammad (peace be upon him) said: Then take it back.

Clarification that the Prophet’s command to return the gift was because it was unjust
Hadith Number: 5101
اخبرنا عبد الله بن محمد الازدي ، قال: حدثنا إسحاق بن إبراهيم ، قال: اخبرنا يحيى بن آدم ، قال: حدثنا زهير بن معاوية ، عن ابي الزبير ، عن جابر ، قال: قالت امراة بشير:" انحل ابني هذا غلاما، واشهد رسول الله صلى الله عليه وسلم، فقال، يعني رسول الله صلى الله عليه وسلم: " اله إخوة؟" قال: نعم، قال:" فاعطيت كل واحد منهم مثل ما اعطيته؟" فقال: لا، فقال:" لا يصلح هذا، وإني لا اشهد إلا على الحق" .
Sayyiduna Jabir (may Allah be pleased with him) narrates: The wife of Sayyiduna Bashir (may Allah be pleased with him) said: Give this son of mine a slave as a gift and make the Prophet (peace and blessings of Allah be upon him) a witness to it. So he, that is, the Prophet (peace and blessings of Allah be upon him), asked (the father of Sayyiduna Nu'man bin Bashir, may Allah be pleased with him): Does he have any other brothers? He replied: Yes. The Prophet (peace and blessings of Allah be upon him) asked: Have you given each of them a gift like you have given him? He replied: No. The Prophet (peace and blessings of Allah be upon him) said: This is not correct, and I only bear witness to what is right.

Report explicitly denying permissibility of favoritism in gifts among children
Hadith Number: 5102
اخبرنا احمد بن علي بن المثنى ، قال: حدثنا ابو خيثمة ، قال: حدثنا جرير ، عن عاصم ، عن الشعبي ، عن النعمان بن بشير ، ان اباه اعطاه غلاما، فقال رسول الله صلى الله عليه وسلم:" ما هذا الغلام؟" قال: غلام اعطانيه ابي، قال: " فكل إخوتك اعطاه كما اعطاك؟" قال: لا، قال:" فاردده"، وقال لابيه:" لا تشهدني على جور" .
Sayyiduna Nu’man bin Bashir (may Allah be pleased with him) narrates: His father gave him a slave as a gift. The Prophet Muhammad (peace and blessings be upon him) inquired,“Whose slave is this?”He replied,“This is the slave whom my father has given to me.”The Prophet (peace and blessings be upon him) asked,“Have he given all your brothers the same as he has given you?”Sayyiduna Nu’man (may Allah be pleased with him) replied,“No.”The Prophet (peace and blessings be upon him) said,“Then return it.”The Prophet (peace and blessings be upon him) said to his father,“Do not make me a witness to an act of injustice.”

Second report clearly stating favoritism among children in gifts is not allowed
Hadith Number: 5103
اخبرنا الحسن بن سفيان ، قال: حدثنا حبان بن موسى ، قال: اخبرنا عبد الله ، قال: اخبرنا ابو حيان التيمي ، عن الشعبي ، عن النعمان بن بشير ، قال: سالت امي ابي بعض الموهبة من ماله فالتوى به سنة، ثم بدا له، فوهبها لي، وإنها قالت: لا ارضى حتى تشهد رسول الله صلى الله عليه وسلم، فقال: يا رسول الله، إن ام هذا بنت رواحة قاتلتني منذ سنة على بعض موهبة لابني هذا، وقد بدا لي فوهبتها له، وقد اعجبها ان تشهدك يا رسول الله، فقال:" يا بشير، الك ولد سوى هذا؟" قال: نعم، قال:" لا تشهدني على جور" .
Sayyiduna Nu’man bin Bashir (may Allah be pleased with him) narrates: My mother requested my father to give me something from his wealth as a gift. He kept postponing it for a year, then he thought it appropriate and gave me that thing as a gift. My mother said: I will not be satisfied until you make the Prophet (peace and blessings of Allah be upon him) a witness to this matter. So Sayyiduna Bashir (may Allah be pleased with him) submitted: O Messenger of Allah (peace and blessings of Allah be upon him)! The mother of this boy, who is the daughter of Rawaha, has been telling me for a year to give something as a gift to this son of mine. Now I thought it appropriate, so I have given it to him as a gift. This woman wishes, O Messenger of Allah (peace and blessings of Allah be upon him), that you become a witness to it. The Prophet (peace and blessings of Allah be upon him) asked: O Bashir, do you have any children other than him? He replied: Yes. The Prophet (peace and blessings of Allah be upon him) said: Then do not make me a witness to an act of injustice.

Third report stating favoritism in gifts among children is injustice and not allowed
Hadith Number: 5104
اخبرنا ابو يعلى ، قال: حدثنا ابو خيثمة ، قال: حدثنا جرير ، عن مغيرة ، عن الشعبي ، عن النعمان بن بشير ، قال: طلبت عمرة بنت رواحة إلى بشير بن سعد ان ينحلني نحلا من ماله، وإنه ابى عليها، ثم بدا له بعد حول او حولين ان ينحلنيه، فقال لها: الذي سالت لابني كنت منعتك، وقد بدا لي ان انحله إياه، قالت: لا والله، لا ارضى حتى تاخذ بيده فتنطلق به إلى رسول الله صلى الله عليه وسلم فتشهده، قال: فاخذ بيدي، فانطلق بي إلى رسول الله صلى الله عليه وسلم، فقص عليه القصة، فقال له النبي صلى الله عليه وسلم: " هل لك معه ولد غيره؟" قال: نعم، قال:" فهل آتيت كل واحد منهم مثل الذي آتيت هذا؟" قال: لا، قال:" فإني لا اشهد على هذا، هذا جور، اشهد على هذا غيري، اعدلوا بين اولادكم في النحل كما تحبون ان يعدلوا بينكم في البر، واللطف" ، قال ابو حاتم رضي الله عنه: قوله صلى الله عليه وسلم اشهد على هذا غيري، اراد به الإعلام بنفي جواز استعمال الفعل المامور به لو فعله، فزجر عن الشيء بلفظ الامر بضده، كما قال لعائشة: اشترطي لهم الولاء، فإنما الولاء لمن اعتق.
Sayyiduna Nu’man bin Bashir (may Allah be pleased with him) narrates: (My mother) Amrah bint Rawahah said to (my father) Sayyiduna Bashir bin Sa’d that he should give me (i.e., Sayyiduna Nu’man bin Bashir) a gift from his wealth, but he did not accept the request of that woman. After one or two years passed, he found it appropriate and gave me a gift. He said to that woman: The request you made regarding my son, I did not fulfill it at that time. Now I find it appropriate to give him a gift. That woman said: No, by Allah, I will not be pleased until you take him by the hand and go with him to the Prophet (peace and blessings of Allah be upon him) and make the Prophet (peace and blessings of Allah be upon him) a witness to this matter. Sayyiduna Nu’man bin Bashir (may Allah be pleased with him) narrates: He took me by the hand and went with me to the Prophet (peace and blessings of Allah be upon him) and told him the whole incident. The Prophet (peace and blessings of Allah be upon him) asked him: Do you have any children other than him? He replied: Yes. The Prophet (peace and blessings of Allah be upon him) asked: Have you given each of them the same as you have given him? He replied: No. The Prophet (peace and blessings of Allah be upon him) said: Then I do not become a witness to this, this is injustice. Make someone else a witness besides me. You people should act justly among your children regarding gifts, just as you like them to act justly with you regarding goodness and virtue.
(Imam Ibn Hibban, may Allah have mercy on him, says:) The statement of the Prophet (peace and blessings of Allah be upon him):“Make someone else a witness besides me,”means to inform that if they do this act, then acting upon it will not be permissible. So the Prophet (peace and blessings of Allah be upon him) forbade this matter by using words that command its opposite, just as the Prophet (peace and blessings of Allah be upon him) said to Sayyidah Aisha (may Allah be pleased with her): Leave the condition of wala’ for them, because the right of wala’ belongs to the one who sets free.

Fourth report indicating favoritism in gifts to children is not allowed
Hadith Number: 5105
اخبرنا عبد الله بن محمود بن سليمان ، قال: حدثنا عمرو بن صالح ، قال: حدثنا إبراهيم بن المغيرة ختن ابن المبارك، قال: حدثنا إسماعيل بن ابي خالد ، عن عامر ، عن النعمان بن بشير ، قال: اتى رسول الله صلى الله عليه وسلم بشير بن سعد، فقال: يا رسول الله، إن عمرة بنت رواحة ارادتني ان اتصدق على ابنها بصدقة، وامرتني ان اشهدك عليها، فقال له رسول الله صلى الله عليه وسلم: " هل لك بنون سواه؟" قال: نعم، قال: فكلهم اعطيتهم مثل ما اعطيت هذا؟" قال: لا، قال:" فلا تشهدني على جور" .
Sayyiduna Nu’man bin Bashir (may Allah be pleased with him) narrates: The Prophet Muhammad (peace and blessings be upon him) came to Sayyiduna Bashir bin Sa’d (may Allah be pleased with him), so he said: O Messenger of Allah (peace be upon him)! (My wife) Amrah bint Rawahah has intended that I give something as a gift to her son. She told me: Make the Messenger of Allah a witness to this. The Prophet Muhammad (peace be upon him) said to him: Do you have other children besides him? He replied: Yes. The Prophet Muhammad (peace be upon him) said: Have you given all of them a gift as you have given him? He replied: No. The Prophet Muhammad (peace be upon him) said: Then do not make me a witness to an act of injustice.

Fifth report explicitly stating one should not favor some children over others in gifts
Hadith Number: 5106
اخبرنا عبد الله بن محمد الازدي ، قال: حدثنا إسحاق بن إبراهيم الحنظلي ، قال: اخبرنا إسماعيل بن إبراهيم ، قال: حدثنا داود بن ابي هند ، عن الشعبي ، عن النعمان بن بشير ، قال: إن ابي نحلني كذا وكذا، فاتى بي رسول الله صلى الله عليه وسلم ليشهده، فقال: " اكل ولدك، اعطيت مثل ما اعطيت؟ فقال: لا، فقال رسول الله صلى الله عليه وسلم:" اشهد على هذا غيري، هذا جور" ثم قال:" اتحبون ان يكونوا في البر سواء؟" قال: نعم، قال:" فلا إذا" .
Sayyiduna Nu’man bin Bashir (may Allah be pleased with him) narrates: My father gave me such and such things as a gift. He took me to the Prophet (peace and blessings of Allah be upon him) so that the Prophet (peace and blessings of Allah be upon him) could be a witness to it. The Prophet (peace and blessings of Allah be upon him) asked: Have you given all your children gifts like you have given to him? He replied: No. The Prophet (peace and blessings of Allah be upon him) said: Then make someone else a witness besides me. This is injustice. Then the Prophet (peace and blessings of Allah be upon him) said: Do you not wish that all your children should be equal in showing kindness to you? He replied: Yes, indeed. The Prophet (peace and blessings of Allah be upon him) said: Then this is not correct.
