بَابُ مَا يَجُوزُ لِلْمُحْرِمِ أَكْلُهُ مِنَ الصَّيْدِ
Chapter on What is Permissible for a Person in Ihram to Eat from Game
Hadith Number: 783
وحدثني، عن وحدثني، عن مالك، عن زيد بن اسلم ، عن عطاء بن يسار ، ان كعب الاحبار اقبل من الشام في ركب حتى إذا كانوا ببعض الطريق وجدوا لحم صيد، فافتاهم كعب باكله، قال: فلما قدموا على عمر بن الخطاب بالمدينة ذكروا ذلك له، فقال:" من افتاكم بهذا؟" قالوا: كعب، قال:" فإني قد امرته عليكم حتى ترجعوا"، ثم لما كانوا ببعض طريق مكة مرت بهم رجل من جراد، فافتاهم كعب ان ياخذوه فياكلوه، فلما قدموا على عمر بن الخطاب ذكروا له ذلك، فقال:" ما حملك على ان تفتيهم بهذا؟" قال: هو من صيد البحر، قال:" وما يدريك؟"، قال: يا امير المؤمنين والذي نفسي بيده، إن هي إلا نثرة حوت ينثره في كل عام مرتين"
When Sayyiduna Ka'b al-Ahbar (may Allah be pleased with him) came from Syria, there were some riders with him who had put on ihram on the way. They saw the meat of game, so Sayyiduna Ka'b al-Ahbar (may Allah be pleased with him) permitted them to eat it. When they came to Madinah, they related this to Sayyiduna Umar (may Allah be pleased with him). He said: Who gave you this fatwa? They replied: Sayyiduna Ka'b (may Allah be pleased with him) did. Sayyiduna Umar (may Allah be pleased with him) said: I have made Ka'b your ruler until you return. Then one day, on the way to Makkah, they came across a swarm of locusts. Sayyiduna Ka'b (may Allah be pleased with him) gave the fatwa that they could catch and eat them. When those people came to Sayyiduna Umar (may Allah be pleased with him), they related this to him. He (may Allah be pleased with him) asked Sayyiduna Ka'b (may Allah be pleased with him): How did you give this fatwa? Sayyiduna Ka'b (may Allah be pleased with him) said that the locust is the game of the sea. Sayyiduna Umar (may Allah be pleased with him) said: How so? Sayyiduna Ka'b (may Allah be pleased with him) said: O Commander of the Faithful! By the One in Whose hand is my soul! The locust comes out from the sneeze of a fish, which sneezes twice every year.

Hadith Number: 783B1
وسئل مالك، عما يوجد من لحوم الصيد على الطريق هل يبتاعه المحرم؟ فقال: اما ما كان من ذلك يعترض به الحاج، ومن اجلهم صيد فإني اكرهه وانهى عنه، فاما ان يكون عند رجل لم يرد به المحرمين فوجده محرم فابتاعه فلا باس به
Imam Malik, may Allah have mercy on him, was asked whether a muhrim (person in the state of ihram) should buy game meat found on the way or not. He replied that if the game is hunted for the sake of the pilgrims, then I consider it disliked. However, if it was not hunted for the muhrim but he happens to find it, then there is no harm in buying it.

Hadith Number: 783B2
قال مالك فيمن احرم وعنده صيد قد صاده او ابتاعه: فليس عليه ان يرسله، ولا باس ان يجعله عند اهله
Imam Malik, may Allah have mercy on him, said: If a person enters into the state of ihram and he has a game animal which he has caught or purchased, then it is not necessary for him to release it; rather, he may keep it in his house.

Hadith Number: 783B3
قال مالك في صيد الحيتان في البحر والانهار والبرك وما اشبه ذلك: إنه حلال للمحرم ان يصطاده
Imam Malik, may Allah have mercy on him, said: Hunting fish in rivers, streams, and ponds is lawful for a person in the state of ihram.

Chapter on What is Not Permissible for a Person in Ihram to Eat from Game
Hadith Number: 784
حدثني يحيى، عن مالك، عن ابن شهاب ، عن عبيد الله بن عبد الله بن عتبة بن مسعود ، عن عبد الله بن عباس ، عن الصعب بن جثامة الليثي انه اهدى لرسول الله صلى الله عليه وسلم حمارا وحشيا وهو بالابواء او بودان، فرده عليه رسول الله صلى الله عليه وسلم، فلما راى رسول الله صلى الله عليه وسلم ما في وجهي، قال: " إنا لم نرده عليك إلا انا حرم"
It is narrated from Sayyiduna Sa'b bin Jaththamah Al-Laithi (may Allah be pleased with him) that he sent a wild donkey as a gift to the Messenger of Allah (peace and blessings be upon him) while he (peace and blessings be upon him) was at Abwa or Waddan (these are the names of two places). The Messenger of Allah (peace and blessings be upon him) returned it. Sayyiduna Sa'b (may Allah be pleased with him) says: When the Messenger of Allah (peace and blessings be upon him) saw the expression on my face (i.e., I was saddened because he returned it, and he realized this by looking at my face), he (peace and blessings be upon him) said: "We have returned it because we are in the state of Ihram."

Hadith Number: 785
وحدثني، عن وحدثني، عن مالك، عن عبد الله بن ابي بكر ، عن عبد الله بن عامر بن ربيعة ، قال: رايت عثمان بن عفان بالعرج وهو محرم في يوم صائف قد غطى وجهه بقطيفة ارجوان، ثم اتي بلحم صيد، فقال لاصحابه:" كلوا"، فقالوا: او لا تاكل انت؟ فقال: " إني لست كهيئتكم، إنما صيد من اجلي"
It is narrated from Abdullah bin Amir bin Rabi'ah that I saw Sayyiduna Uthman bin Affan, may Allah be pleased with him, at 'Arj on a hot day; he had covered his face with a red blanket. Meanwhile, some game meat was brought, so he said to his companions: Eat. They said: Will you not eat? He, may Allah be pleased with him, replied: I am not like you; it has been hunted for my sake.

Hadith Number: 786
وحدثني، عن وحدثني، عن مالك، عن هشام بن عروة ، عن ابيه ، عن عائشة ام المؤمنين، انها قالت له:" يا ابن اختي إنما هي عشر ليال فإن تخلج في نفسك شيء فدعه" تعني اكل لحم الصيد
Umm al-Mu'mineen Sayyidah Aisha (may Allah be pleased with her) said to Urwah bin Zubair: O son of my brother! These are the ten nights of Ihram. If you have any doubt in your heart, then completely abstain from the meat of game.

Hadith Number: 786B1
قال مالك في الرجل المحرم يصاد من اجله صيد، فيصنع له ذلك الصيد فياكل منه وهو يعلم انه من اجله صيد: فإن عليه جزاء ذلك الصيد كله
Imam Malik, may Allah have mercy on him, said that if game is hunted for the sake of a muhrim, and he eats it knowing that it was hunted for him, then its penalty is obligatory upon him.

Hadith Number: 786B2
وسئل مالك، عن الرجل يضطر إلى اكل الميتة وهو محرم، ايصيد الصيد فياكله ام ياكل الميتة؟ فقال: بل ياكل الميتة، وذلك ان الله تبارك وتعالى لم يرخص للمحرم في اكل الصيد، ولا في اخذه في حال من الاحوال، وقد ارخص في الميتة على حال الضرورة
Imam Malik, may Allah have mercy on him, was asked: If a person is in such a state of necessity that carrion becomes lawful for him, and he is in the state of ihram, should he hunt and eat or eat carrion? Imam Malik, may Allah have mercy on him, replied: He should eat carrion, because Allah, Glorious and Exalted is He, has not given permission to the muhrim (one in ihram) to hunt in any situation, but has given permission to eat carrion at the time of necessity.

Hadith Number: 786B3
قال مالك: واما ما قتل المحرم او ذبح من الصيد، فلا يحل اكله لحلال ولا لمحرم، لانه ليس بذكي كان خطا او عمدا فاكله لا يحل، وقد سمعت ذلك من غير واحد
Imam Malik, may Allah have mercy on him, said: The game that is killed or slaughtered, its eating is not permissible for anyone, neither for the Muhrim nor for the Halal, because it has not been properly slaughtered. It makes no difference whether it was killed by mistake or intentionally, in no case is it permissible. Imam Malik, may Allah have mercy on him, said: I have heard this issue from many people.
