Imam Malik, may Allah have mercy on him, said: Whoever is required to offer a sacrificial animal (hady) as a penalty for hunting, or for any other reason that makes the hady obligatory upon him, he should bring the hady to Mecca, as Allah the Exalted has said: «﴿هَدْيًا بَالِغَ الْكَعْبَةِ﴾» (5-al-Ma'idah:95), meaning "a sacrificial animal that reaches the Ka'bah." And whoever is required to fast or give charity in place of hunting or in place of the hady, then he has the choice to fast wherever he wishes, or to give charity either in the Haram or outside the Haram.

It is narrated from Abu Asma, who was the freed slave of Abdullah bin Ja'far, that he went out with Abdullah bin Ja'far from Madinah (for Hajj), and they passed by Sayyiduna Husayn bin Ali, may Allah be pleased with them both, and he was ill at Suqya. So Abdullah bin Ja'far stayed there until, when he feared missing Hajj, Abdullah bin Ja'far set out and sent a man to Sayyiduna Ali, may Allah be pleased with him, and to his wife Sayyida Asma bint Umais, may Allah be pleased with her, and they were both in Madinah. So Sayyiduna Ali, may Allah be pleased with him, and Sayyida Asma, may Allah be pleased with her, came from Madinah to Sayyiduna Imam Husayn, may Allah be pleased with him. He pointed to his head. Sayyiduna Ali, may Allah be pleased with him, ordered that his head be shaved at Suqya, then a camel was sacrificed on his behalf there at Suqya. Yahya bin Sa'id said that Sayyiduna Imam Husayn, may Allah be pleased with him, had set out for Hajj with Sayyiduna Uthman bin Affan, may Allah be pleased with him.

It reached Imam Malik, may Allah have mercy on him, that the Messenger of Allah, peace and blessings be upon him, said: "All of Arafat is a place for staying, except do not stay in the valley of ‘Urnah, and all of Muzdalifah is a place for staying, except do not stay in the valley of Muhassir."

Imam Malik, may Allah have mercy on him, said that Allah, the Blessed and Exalted, said: «﴿فَلَا رَفَثَ وَلَا فُسُوقَ وَلَا جِدَالَ فِي الْحَجِّ﴾ [البقرة: 197] » "There is to be no sexual relations, no disobedience, and no arguing during Hajj." The meaning of «رفث» is sexual intercourse, and Allah knows best. Allah, the Blessed and Exalted, said: «﴿أُحِلَّ لَكُمْ لَيْلَةَ الصِّيَامِ الرَّفَثُ إِلَى نِسَائِكُمْ﴾ [البقرة: 187] » "It is made lawful for you to have sexual relations with your wives during the nights of fasting." Here, "rafath" refers to sexual intercourse.

Imam Malik, may Allah have mercy on him, said: And by "fisq" is meant the slaughtering of animals for idols. Allah, the Exalted, said: «﴿أَوْ فِسْقًا أُهِلَّ لِغَيْرِ اللّٰهِ بِهِ﴾ [الأنعام: 145] » "Or fisq is that upon which a name other than Allah's has been invoked." And "arguing" refers to the fact that the Quraysh used to stay at Muzdalifah near Qazah, while everyone else would descend at Arafat, so the two groups would fight and argue with each other, saying: "We are on the straight and correct path." The others would say: "We are on the right way." So Allah, the Exalted, said: «﴿لِكُلِّ أُمَّةٍ جَعَلْنَا مَنْسَكًا هُمْ نَاسِكُوهُ، فَلَا يُنَازِعُنَّكَ فِي الْأَمْرِ وَادْعُ إِلَى رَبِّكَ إِنَّكَ لَعَلَى هُدًى مُسْتَقِيمٍ﴾ [الحج: 67] » meaning, "We have appointed for every group a way which they follow, so do not argue with you in the matter of religion, and call to your Lord, surely you are on the straight path." So this is the meaning of arguing during Hajj. (And Allah knows best), and I have heard this from the people of knowledge.

Imam Malik, may Allah have mercy on him, was asked whether a person can stay at Arafat or Muzdalifah without ablution, or throw pebbles without ablution, or run between Safa and Marwah without ablution? He replied: All the acts that a menstruating woman can perform, a man without ablution can also perform, and nothing is obligatory upon him except that it is better to remain in a state of ablution for all these acts, and it is not good to be deliberately without ablution.

Imam Malik, may Allah have mercy on him, was asked whether one should stay at Arafat while mounted or dismounted. He replied: While mounted. But if there is an excuse for him or his animal, then Allah, Glorious and Exalted is He, accepts the excuse.

It is narrated from Nafi‘ that Sayyiduna Abdullah bin Umar, may Allah be pleased with them both, used to say: Whoever did not stay at ‘Arafah until the dawn of the Day of Sacrifice, his Hajj has lapsed; and whoever stayed at ‘Arafah before the dawn of the Day of Sacrifice, he has attained Hajj.

Imam Malik, may Allah have mercy on him, said: If a slave is freed at Arafat, this will not be his obligatory Hajj unless he has not yet assumed Ihram, and if after being freed he assumes Ihram and stays at Arafat before the dawn of the Day of Sacrifice, then his obligatory Hajj will be fulfilled. If he does not assume Ihram until the break of dawn, then his example is like that of someone whose Hajj has lapsed and who did not attain the standing at Arafat until the dawn of the night of Muzdalifah; thus, it will remain obligatory upon this slave to perform the obligatory Hajj.
