Al-Fath al-Rabbani
بَابُ لَا نِكَاحَ إِلَّا بِوَلِيٍّ وَمَا جَاءَ فِي زِوَاجِ الْعَبْدِ بِغَيْرِ إذن سَيّدِهِ
Chapter: No Marriage Except with a Guardian and What Has Been Reported Regarding a Slave Marrying Without His Master's Permission
Hadith Number: 6878
عن ابن عباس عن النبي صلى الله عليه وآله وسلم قال: ((لا نكاح إلا بولي والسلطان ولي من لا ولي له))
Narrated by Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both): The Noble Prophet (peace and blessings be upon him) said: There is no marriage without a guardian, and whoever has no guardian, the Sultan will be her guardian.

عن ابي بردة عن ابيه قال: قال رسول الله صلى الله عليه وآله وسلم: ((لا نكاح إلا بولي))
Narrated by Sayyiduna Abu Musa Ash'ari (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him and his family) said: There is no marriage except with a guardian.

Hadith Number: 6880
عن ابن عباس ان النبي صلى الله عليه وآله وسلم خطب ميمونة بنت الحارث، فجعلت امرها إلى العباس فزوجها النبي صلى الله عليه وآله وسلم
Narrated by Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both): The Prophet Muhammad (peace and blessings be upon him) sent a proposal of marriage to Sayyida Maymunah bint Harith (may Allah be pleased with her). She entrusted the matter of her marriage to Sayyiduna Abbas (may Allah be pleased with him), and Sayyiduna Abbas (may Allah be pleased with him) married her to the Prophet (peace and blessings be upon him).

Hadith Number: 6881
عن عقبة بن عامر رضي الله عنه ان النبي صلى الله عليه وآله وسلم قال إذا انكح الوليان فهو للاول منهما وإذا باع من رجلين فهو للاول منهما قال ابي وقال يونس وإذا باع الرجل بيعا من رجلين
It is narrated from Sayyiduna Uqbah bin Amir (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) said: When a woman is married off by two guardians, the marriage of the first guardian will be considered valid. Similarly, when a man sells an item to two men, it will belong to the first one. The words of the narrator Yunus are: When a man sells to two slaves.

Hadith Number: 6882
عن جابر بن عبد الله رضي الله عنهما ايما عبد تزوج بغير إذن مواليه او اهله فهو عاهر
Narrated by Sayyiduna Jabir bin Abdullah (may Allah be pleased with both of them) that any slave who marries without the permission of his master or household will be considered an adulterer.

بَاب مَا جَاءَ فِي إِجْبَارِ الْبِكْرِ وَاسْتَثَمَارِ التَّيبِ
Chapter: What Has Been Reported Regarding Compelling the Virgin and Seeking the Consent of the Previously Married Woman
Hadith Number: 6883
عن ابن عباس رضي الله عنهما ان رسول الله صلى الله عليه وآله وسلم قال ليس للولي مع الثيب امر واليتيمة تستامر فصمتها إقرارها
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that the Noble Prophet (peace and blessings be upon him) said: The guardian has no authority in the matter of a widow’s marriage, and permission should be sought from a virgin girl, and her silence will be considered her consent.

وعنه ايضا قال قال رسول الله صلى الله عليه وآله وسلم الايم احق بنفسها من وليها والبكر تستامر في نفسها وإذنها صماتها
It is also narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that the Noble Prophet (peace and blessings be upon him) said: A widow has more right over herself than her guardian, and a virgin girl should be asked for permission regarding herself, and her permission is her silence.

(وعنه من طريق ثان) يبلغ به النبي صلى الله عليه وآله وسلم الثيب احق بنفسها من وليها والبكر يستامرها ابوها في نفسها وإذنها صماتها
(Second chain) The Noble Prophet, peace and blessings be upon him, said: A widow has more right over herself than her guardian, and the father of a virgin should seek her permission regarding herself, and her silence is her permission.

عن ابي هريرة رضي الله عنه قال قال رسول الله صلى الله عليه وآله وسلم البكر تستامر والثيب تشاور قيل يا رسول الله إن البكر تستحيي قال سكوتها رضاها
Narrated from Sayyiduna Abu Hurairah, may Allah be pleased with him, that the Noble Prophet, peace and blessings be upon him, said: Permission will be sought from a virgin, and consultation will be done with a widow. Someone said: O Messenger of Allah! A virgin feels shy. He, peace and blessings be upon him, said: Her silence is her consent.

(وعنه من طريق ثان) قال قال رسول الله صلى الله عليه وآله وسلم الثيب تستامر في نفسها والبكر تستاذن قالوا يا رسول الله كيف إذنها قال ان تسكت
(Second chain) The Messenger of Allah, peace and blessings be upon him, said: The widow should be consulted regarding herself, and the virgin's permission should be sought. The people said: O Messenger of Allah! What is her permission? He, peace and blessings be upon him, said: Her silence.
