Mishkat al-Masabih
(فَضِيلَةُ التَّاجِرِ المُتَّقِي)
(The virtue of the pious merchant)
Hadith Number: 2799
وعن عبيد بن رفاعة عن ابيه عن النبي صلى الله عليه وسلم قال: «التجار يحشرون يوم القيامة فجارا إلا من اتقى وبر وصدق» . رواه الترمذي وابن ماجه
‘Ubaid b. Rifa'a on his father’s authority reported the Prophet as saying, "The merchants will be raised up on the day of resurrection as evildoers, except those who fear God, are honest and speak the truth.”Tirmidhi, Ibn Majah and Darimi transmitted it.
قال الشيخ زبير على زئي:صحيح

(The virtue of the pious merchant, narrated by Al-Bayhaqi and Tirmidhi)
Hadith Number: 2800
وروى البيهقي في شعب الإيمان. عن البراء وقال الترمذي: هذا حديث حسن صحيح وهذا الباب خال من الفصل الثالث
Baihaqi transmitted it in Shu'ab al-iman on the authority of al-Bara’. Tirmidhi said this is a hasan sahih tradition.
قال الشيخ زبير على زئي:صحيح
(بَيَانُ الخِيَارِ فِي مُعَامَلَةِ البَيْعِ وَالشِّرَاءِ)
(Explanation of Khiyar in the transaction of buying and selling)
Hadith Number: 2801
عن ابن عمر قال: قال رسول الله صلى الله عليه وسلم: «المتبايعان كل واحد منهما بالخيار على صاحبه ما لم يتفرقا إلا بيع الخيار» وفي رواية لمسلم: «إذا تبايع المتبايعان فكل واحد منهما بالخيار من بيعه ما لم يتفرقا او يكون بيعهما عن خيار فإذا كان بيعهما عن خيار فقد وجب» وفى رواية للترمذي: «البيعان بالخيار ما لم يتفرقا او يختارا» . وفي المتفق عليه: او يقول احدهما لصاحبه: اختر «بدل» او يختارا
Ibn 'Umar reported God's Messenger as saying, "Both parties in a business transaction have a right to annul it so long as they have not separated, except in transactions which have been made subject to the right of the parties to annul them.”The version by Bukhari and Muslim has "or one of them tells the other to exercise his right”instead of "or exercise the right.”(Bukhari and Muslim.) A version by Muslim says, "Both parties in a business transaction have a right to annul the bargain so long as they have not separated, or when their bargain has attached to it the right to annul it, for when such a condition has been made it remains valid.”A version by Tirmidhi says, "The two parties in a business transaction have a right to annul it so long as they have not separated, or exercise the right.”

(البَرَكَةُ فِي قَوْلِ الصِّدْقِ أَثْنَاءَ البَيْعِ وَالشِّرَاءِ)
(Blessing in speaking the truth during buying and selling)
Hadith Number: 2802
وعن حكيم بن حزام قال: قال رسول الله صلى الله عليه وسلم: «البيعان بالخيار ما لم يتفرقا فإن صدقا وبينا بورك لهما في بيعهما وإن كتما وكذبا محقت بركة بيعهما»
Hakim b. Hizam reported God’s Messenger as saying, "Both parties in a business transaction have a right to annul it so long as they have not separated ; and if they tell the truth and make everything clear they will be blessed in their transaction, but if they conceal anything and lie the blessing on their transaction will be blotted out.”(Bukhari and Muslim.)
قال الشيخ زبير على زئي:متفق عليه
(مَا يَجِبُ قَوْلُهُ أَثْنَاءَ البَيْعِ وَالشِّرَاءِ)
(What should be said during buying and selling)
Hadith Number: 2803
وعن ابن عمر قال: قال رجل للنبي صلى الله عليه وسلم إني اخدع في البيوع فقال: إذا بايعت فقل: لا خلابة فكان الرجل يقوله
Ibn ‘Umar said that a man told the Prophet that he was being deceived in business transactions, and he replied, "When you make a bargain say, 'There is no attempt to deceive'*.”Then the man made a habit of saying that. (Bukhari and Muslim.) * He was to say this to protect himself because he was not expert enough to detect defects in what he was buying. Some hold that one who says this has the right to cancel the transaction if any defect is discovered within three days. Some say this applied only to the man who spoke to the Prophet; others say it applies to anyone.

(اخْتِيَارُ الإِبْقَاءِ عَلَى السُّودَا أَوْ إِلْغَائِهَا قَبْلَ التَّفَرُّقِ)
(The option to keep or cancel a transaction before parting)
Hadith Number: 2804
عن عمرو بن شعيب عن ابيه عن جده ان رسول الله صلى الله عليه وسلم قال: «البيعان بالخيار ما لم يتفرقا إلا ان يكون صفقة خيار ولا يحل له ان يفارق صاحبه خشية ان يستقيله» . رواه الترمذي وابو داود والنسائي
Amr b. Shu'aib, on his father's authority, said that his grandfather reported God’s Messenger as saying,“Both parties in a business transaction have a right to annul it so long as they have not separated unless it is a bargain with the right to annul it attached to it; and one has not the right to separate from the other for fear that he may demand that the bargain be rescinded.”Tirmidhi, Abu Dawud and Nasa’i transmitted it.

(الافْتِرَاقُ بِرِضَا الطَّرَفَيْنِ)
(Parting with mutual consent)
Hadith Number: 2805
وعن ابي هريرة عن النبي صلى الله عليه وسلم قال: «لا يتفرقن اثنان إلا عن تراض» . رواه ابو داود
Abu Huraira reported the Prophet as saying,“Two people must separate only by mutual consent.”Abu Dawud transmitted it.

(اخْتِيَارُ تَغْيِيرِ السُّودَا بَعْدَ البَيْعِ)
(The option to alter a transaction after the sale)
Hadith Number: 2806
عن جابر رضي الله عنه ان رسول الله صلى الله عليه وسلم خير اعرابيا بعد البيع. رواه الترمذي وقال: هذا حديث حسن صحيح غريب
Jabir told that God’s Messenger gave a desert Arab the right to rescind a bargain after having made it. Tirmidhi transmitted it, saying this is a hasan sahih gharib tradition.
قال الشيخ زبير على زئي:سنده ضعيف
(لَعْنَةٌ عَلَى آخِذِ السُّودِ وَمُعْطِيهِ)
(Curse on the taker and giver of usury)
Hadith Number: 2807
عن جابر رضي الله عنه قال: لعن رسول الله صلى الله عليه وسلم اكل الربا وموكله وكاتبه وشاهديه وقال: «هم سواء» . رواه مسلم
Jabir said that God's Messenger cursed the one who accepted usury, the one who paid it, the one who recorded it, and the two witnesses to it, saying they were all alike. Muslim transmitted it.

(بَيَانُ الأَشْيَاءِ المَبِيعَةِ مُتَسَاوِيَةً)
(Explanation of items sold on an equal basis)
Hadith Number: 2808
وعن عبادة بن الصامت قال: قال رسول الله صلى الله عليه وسلم: «الذهب بالذهب والفضة بالفضة والبر بالبر والشعير بالشعير والتمر بالتمر والملح بالملح مثلا بمثل سواء بسواء يدا بيد فإذا اختلفت هذه الاصناف فبيعوا كيف شئتم إذا كان يدا بيد» . رواه مسلم
‘Ubada b. as-Samit reported God's Messenger as saying, "Gold is to be paid for by gold, silver by silver, wheat by wheat, barley by barley, dates by dates, and salt by salt, like for like and equal for equal, payment being made on the spot. If these classes differ, sell as you wish if payment is made on the spot.”Muslim transmitted it.
