Regarding a Slave Permitted by His Master to Trade

٢٢١٤٦ - حدثنا ابو بكر قال: حدثنا وكيع عن سفيان عن حماد في الرجل ياذن لعبده فيدان ثم يعتقه مولاه، قال: يضمن مولاه القيمة.
A slave whom the master has permitted to engage in trade, then he becomes indebted and his master also sets him free. Regarding this slave, Hammad (may Allah have mercy on him) says that his master will be liable for the price of this slave. And Sufyan (may Allah have mercy on him) says that his creditors will continue to pursue him for the remaining debt until he pays it off.

٢٢١٤٧ - (و) (١) قال: سفيان: يتبع غرماءه بما بقي من الدين (٢).

(٢) أي أن حمادًا يرى أن السيد إذا أعتق عبده المأذون له بالتجارة المدين يلزمه سداد قيمة المملوك لدائنه فقط، بينما يرى سفيان أن السيد يسدد جميع الدين.
22147 - (W) (1) He said: Sufyan: His creditors follow him for what remains of the debt (2).

٢٢١٤٨ - حدثنا ابو بكر قال: حدثنا عبد الاعلى بن عبد الاعلى عن معمر عن الزهري في الرجل يفلس فيعتقه سيده: ان عتقه جائز ويضمن السيد ثمنه.
Hazrat Imam Zuhri, may Allah have mercy on him, says regarding the slave who becomes destitute and his master sets him free, that setting him free is permissible and the master will be responsible for his price.

٢٢١٤٩ - حدثنا ابو بكر قال: حدثنا عبد الصمد بن عبد الوارث عن جرير بن حازم عن حماد قال: إن اعتقه سيده فالدين على سيده.
Hazrat Hammad (may Allah have mercy on him) says that if the master sets him free, then the master is responsible for the payment of the debt.

Ibrahim (may Allah have mercy on him) said that he will strive to pay off the creditors’ debts, and freedom did not add anything except his ability.

If a Slave Trades Without His Master’s Permission and Incurs Debt

٢٢١٥١ - حدثنا ابو بكر قال: حدثنا (محمد) (١) بن ابي عدي عن اشعث عن الحسن قال: إذا ادان العبد بغير إذن مواليه ثم اعتق، فإنه يباع بذلك الدين.

Hasan (may Allah have mercy on him) said that if a slave conducts trade without the permission of his master and becomes indebted, then he is set free, indeed he will be sold for that debt.

٢٢١٥٢ - حدثنا ابو بكر قال: حدثنا عبد الاعلى عن معمر عن الزهري في العبد يبيع ويشتري بغير إذن سيده، قال: ليس على سيده شيء، هو في ذمة العبد، إذا اعتق فعليه.
Hazrat Zuhri (may Allah have mercy on him) says that if a slave buys or sells without the permission of his master, nothing will be obligatory upon the master; everything will be the responsibility of the slave, and when he is freed, everything will remain obligatory upon him.

٢٢١٥٣ - حدثنا ابو بكر قال: حدثنا (عبد الصمد) (١) بن عبد الوارث عن جرير ابن حازم قال: سئل حماد عن عبد اشترى بغير إذن سيده فاعتقه فليس عليه شيء، واموالهم في (ذمة) (٢) العبد إذا اعتق.

Hazrat Hammad, may Allah have mercy on him, was asked: If a slave buys and sells without the permission of his master, and then he is set free, he replied: Nothing will be obligatory upon the master; the debts of the creditors will remain upon the slave when he is set free.

If a Man Has Relations with a Slave Girl After Purchase, Then Discovers a Defect

٢٢١٥٤ - حدثنا ابو بكر قال: حدثنا (شريك) (١) عن جابر عن عامر (عن) (٢) عمر (٣) قال: إن كانت ثيبا رد نصف العشر، وإن كانت بكرا رد (٤) العشر (٥).

Hazrat Umar (may Allah be pleased with him) said that if the slave woman was previously married, then one should take back one-twentieth; and if she was a virgin, then one should take back one-tenth.
