٢٩٥٨١ - حدثنا ابو بكر قال: حدثنا عبد الرحيم عن اشعث عن عامر و (الحسن) (١) وابن سيرين وعمرو بن دينار قالوا: العمد قود.

Hazrat Ash'ath narrates that Hazrat 'Amir Sha'bi, Hasan Basri, Hazrat Ibn Sirin, and Hazrat 'Amr bin Dinar stated: In the case of intentional murder, there will be retribution (qisas).

٢٩٥٨٢ - حدثنا ابو بكر قال: حدثنا عبد الرحيم عن إسماعيل عن عمرو بن دينار عن طاوس عن ابن عباس قال: قال رسول الله ﷺ:"العمد قود إلا ان يعفو ولي المقتول" (١).

(١) ضعيف؛ إسماعيل هو ابن مسلم المكي ضعيف؛ وأخرجه الدارقطني ٣/ ٩٤، وإسحاق كما في نصب الراية ٤/ ٣٢٧، ورواه بلفظ: (من قتل عمدًا فهو قود) أبو داود (٤٥٣٩)، والنسائي (٦٩٩٣)، وابن ماجه (٢٦٣٥)، والبيهقي ٨/ ٤٥، وأخرجه الشافعي في الأم ٧/ ٣٣٠ مرسلًا، وأخرجه الطبراني في الأوسط (٢٢٦) عن طاووس عن أبي هريرة.
Hazrat Ibn Abbas (may Allah be pleased with them) narrates that the Messenger of Allah (peace and blessings be upon him) said: In the case of intentional murder, retribution (qisas) will be taken, except if the guardian of the murdered person forgives.

٢٩٥٨٣ - حدثنا ابو بكر قال: حدثنا حفص عن الشيباني عن الشعبي والحكم وحماد قالوا: ما كان من ضربة بسوط او عصى او حجر فكان دون النفس فهو عمد وفيه القود.
Hazrat Shaibani states that Hazrat Sha'bi, Hazrat Hakam, and Hazrat Hammad said: Whoever strikes with a whip, stick, or stone, and it is less than causing death, then it will be considered intentional (amdan), and qisas (retaliation) will be applicable in it.

٢٩٥٨٤ - حدثنا ابو بكر قال: حدثنا عبد الاعلى عن معمر عن الزهري قال: إذا اجتمع رجل وغلام على قتل رجل قتل الرجل، وعلى عاقلة الغلام الدية كاملة.
Hazrat Muammar narrates that Hazrat Zuhri said: When a man and a boy participate together in the murder of a man, then the man will be killed and the boy’s family will be liable for the full blood money (diyah).

٢٩٥٨٥ - حدثنا ابو بكر قال: حدثنا عبد الصمد بن عبد الوارث عن جرير بن حازم قال: سئل حماد عن رجل وصبي قتلا رجلا عمدا قال: اما الرجل (يقتل) (١)، واما الصبي فعلى (اوليائه) (٢) (حصته) (٣) من الدية.

Hazrat Jarir bin Hazim narrates that Hazrat Hammad was asked about a man and a child who have intentionally killed someone, so what is the ruling regarding them? He replied: The man will be killed, and the guardians of the child will be liable to pay the blood money for his share.

٢٩٥٨٦ - حدثنا ابو بكر قال: حدثنا محمد بن (سواء) (١) عن سعيد عن حماد عن إبراهيم قال: إذا اعانه من لا يقاد به فإنما هي دية.

Hazrat Hammad states that Ibrahim said: When, in a case of murder, someone assisted who cannot be subjected to retribution (qisas), then in that situation, blood money (diyat) will be applicable.

٢٩٥٨٧ - حدثنا ابو بكر قال: حدثنا حفص عن عمرو عن الحسن قال: إذا اجتمع صبي وعبد على قتل فهي دية، (فإذا) (١) اجتمعا فضرب هذا بسيف وهذا بعصى فهو دية.

Hazrat Amr narrates that Hasan Basri said: When a child and a slave are involved together in a murder, then blood money (diyat) will be due; and when both are involved in such a way that one struck with a sword and the other with a stick, even then blood money (diyat) will be due.

٢٩٥٨٨ - حدثنا ابو بكر قال: حدثنا يزيد قال: حدثنا هشام عن الحسن في القوم يقتلون عمدا وفيهم الصبي والمعتوه، قال: هي دية خطا على العاقلة.
Hazrat Hisham states that Hasan Basri, regarding a people who had committed murder intentionally in such a way that among them were also children and the insane, said: In this case, the blood money for accidental killing will be upon the family members.

٢٩٥٨٩ - حدثنا ابو بكر قال: حدثنا محمد بن يزيد عن ابي العلاء عن ابي هاشم (١) عن إبراهيم.

Ibrahim and Hasan Basri said: Regarding a man who was deliberately killed, and the killer was imprisoned so that he could be killed in retribution for the murdered person. Then a man came and mistakenly killed this killer, so his blood money will be given to the family of the prisoner, and Hazrat Ata said: The family of the first murdered person will receive his blood money.

٢٩٥٩٠ - (و) (١) عن قتادة عن الحسن (قالا) (٢): في رجل قتل عمدا (فحبس) (٣) القاتل ليقاد (٤) بالمقتول، فجاء رجل فقتل القاتل خطا، (قالا) (٥): ديته لاهل (المحبوس) (٦).
